What does organized transportation mean? Transportation of children by buses under parental control

In this section, I will try to clarify the organization of transportation of organized groups of children. First of all, it concerns school classes. I studied this issue for almost a year, getting clarifications from competent sources (the prosecutor's office and the traffic police), read the literature on this topic and made my own conclusions. I talked with many people of different levels - these are parents, and teachers, and directors, and representatives of city administrations. I have the opinion that more than half of them simply do not understand the difference between the concepts " school transportation"and" an organized group of children. "I will try to put everything on the shelves, I am ready to answer your questions, enter into discussions and, in order to establish the truth, apply, as I do, to various authorities.

So what is "school transportation"? This is the transport of schoolchildren, organized by the school and paid by her. For example, schoolchildren need to be taken to and from lessons every day. To do this, the school enters into an agreement with a transport company and pays for transport services from its own account. In this case, the school management is responsible for the life and health of children, for which, before concluding an agreement, the school must check all documents transport company and make sure they can be trusted with children. And now let's take another situation, the most common one - school classes going on excursions. As a mother of a schoolchild, I know perfectly well how this happens. The class teacher or parents offer to take the class, for example, to the Paleontological Museum. Hurray, everyone is in favor, because they understand that this is both useful and interesting. And then the fun begins. The trip is scheduled for NON-school time, but for some reason the class teacher writes to the director memo with information about the trip, and if the director does not sign an order for the school that he orders a tour and appoints this class teacher responsible, then the trip will not take place. In some cities of the Moscow region, you must obtain permission from the Department of Education! THIS IS COMPLETELY WRONG! I will explain why: 1) Your trip has nothing to do with school, because it takes place OUTSIDE OF SCHOOL. When the child left the school, his classes ended, only you are responsible for him. You don't ask the director's permission when you want to send your child and friends to the cinema on the weekend :) 2) Parents pay for the trip from their own funds. This once again proves that the school and the Department of Education do not have the right to dictate their terms to you. 3) "But the class teacher is coming with us" - I heard this phrase more than once. Well, well, let him go. Only on this trip he will not be a class teacher, but ordinary person, your guest whom you invited with you. 4) "It is necessary to conclude an agreement with the school" - another misconception. I, as a carrier, will conclude an agreement in the form of a work order, which is for one-time trips, with the person who organizes the tour and with whom I will conduct cash settlements. To the same person, at his first request, I will provide all the documents that confirm my right to transport children.

Situation 2 - the trip is organized during STUDY time. You need to remove the whole class from the lessons. Just like that, arbitrarily, you cannot do it. In this case, the class teacher must inform the principal of the school about the upcoming trip. The director has the right not to give you his permission if there are good reasons for this - for example, on this day your class will have an important test. But a competent class leader himself will not appoint a trip on such a day. If everything is fine and the director has no objections to your trip, then he signs an order for the school to organize the trip, where he appoints the class teacher responsible. Next are going Required documents which are listed below.

Now the list of documents required for the transportation of organized groups of children:

1) Order-order. If there is no need to carry out systematic transportation of passengers and baggage on order, the charter agreement is concluded in the form of an order for the provision of a vehicle for the transportation of passengers and baggage. The details and the procedure for filling out such an order-order are established by the rules for the carriage of passengers. (Article 27 of the Federal Law of November 8, 2007 No. 259-FZ "Charter road transport and urban ground electric transport). I, as a carrier, provide you with the order form.

2) List of children (indicating the last name, first name, patronymic and age of each child) and list of assigned escorts(indicating the last name, first name, patronymic of each accompanying person, his phone number). No more additional information(for example, home address or phone number of all relatives up to the seventh generation) is not required! To cast aside doubts, you can see the DECISION of the Government of the Russian Federation of December 17, 2013 N 1177 (paragraph 4 "e").

3) A document containing the procedure for boarding children on the bus. I, as a carrier, provide you. It is a diagram of a bus with seats (in the diagram in the form of squares). In each box you enter the name of the child or adult, according to the places taken.

4) Schedule of movement (or in another way Scheme of the route), which includes the estimated time of transportation, indicating the places and times of stops for rest and food, if any. This is not difficult to do. You plot a route, for example, in Yandex.Maps and print it out on a printer.

5) Accompanying a group of children by a medical worker. Attention! This is necessary only if you are traveling in a convoy (at least 3 buses) and will be on the road for more than 3 hours. In other cases, the presence of honey. employee is not required. We are watching REGULATION OF THE GOVERNMENT OF THE RUSSIAN FEDERATIONdated December 17, 2013 N 1177 (paragraph 12).

6) Order for the school. It is done if the trip is issued from the school.

And the last but very important question. Is it necessary to provide the bus for inspection to the traffic police before the trip. Yes, absolutely, in accordance with the REGULATION dated June 30, 2015 N 652ABOUT CHANGESIN SOME ACTS OF THE GOVERNMENT OF THE RUSSIAN FEDERATION IN PARTIMPROVING THE RULES FOR ORGANIZED CARRIAGE OF A GROUPCHILDREN BY BUSES. Thus, you must have another document "Notification of the traffic police about the transportation of an organized group of children." I must say right away that both an organization (for example, a school) and an individual (for example, a parent) can organize a trip. Accordingly, the Notice may be from any person. I will provide you with a Notification Form if necessary.

If you have any questions, you can ask them in the "Feedback and Questions" section or in a personal letter. The Regulations and Rules to which I refer are on this site in the "Documents" section.

Have cool trips with your class! :)
