The essence of the concept of the minimum wage
The minimum wage in Russia is a measure used to:
- determining the amount of social payments in certain cases;
- calculation of payments for hospital employees with little experience;
- calculation of mandatory contributions from individual entrepreneurs (IE) and self-employed citizens.
In abbreviated form, the lower salary threshold is abbreviated as "minimum wage". It is installed on two levels:
- as a whole for the federation;
- separately in each region (indicators may differ in value).
In a market economy, the employer himself appoints a salary to workers based on the current situation, costs and other factors. Unfortunately, not all owners of firms and industries care about the interests of the population. This function in Russian Federation assigned to the state in the framework of the formation of economic policy.
Important: The minimum wage is used in accounting to determine some payments and contributions. It is necessary to clearly understand which indicator (federal or regional) is taken into account in a particular case.
Factors affecting the size of the minimum wage

- per capita - 10328 rubles;
- for the able-bodied population - 11,160 rubles;
- for pensioners - 8496 rubles;

Some features of the application of the minimum wage in calculations
The accountant needs to take into account the size of the minimum wage set by the governments of both levels of government.
The rules are:
- The amount of accruals per month cannot be lower than the federal indicator (with the exception of the preferential regime of work).
- The regional value is used by enterprises that have joined the minimum wage agreement.
- If the organization has not become a party to a tripartite agreement, then the all-Russian minimum wage is used.
Salary less than the minimum wage: in what cases is it possible
- The employee works part-time. Salary will be calculated based on hours worked. It is necessary to conclude an additional agreement of the parties.
- The employee combines work in several companies. In this case, it is possible to hire on a part-time basis (no more), therefore, the salary will be less or 50% of the minimum wage.
- The salary of an employee includes a fixed salary and bonuses (allowances). If the monthly norm is not met, then the allowance (premium) is not charged. As a result, the amount of salary payable may be less than the minimum wage.
Salary less than the minimum wage: what is the responsibility in 2019
If the above conditions are not met at the enterprise and employees are paid salaries less than the minimum threshold, penalties will follow.
The amount of fines depends on:
- the number of violations;
- the size and legal status of the enterprise.
For individual entrepreneurs and heads (chief accountants) of enterprises:
- For the primary violation - a fine of 1-5 thousand rubles.
- In case of repeated violation - a fine of 10-20 thousand rubles.
For legal entities:
- For the primary violation - a fine of 30-50 thousand rubles.
- In case of repeated violation - a fine of 50-70 thousand rubles.
Disqualification for a period of 1-3 years may also be applied.
Important! The minimum wage in the Russian Federation includes salary, bonuses (allowances, raises). Consequently, the salary itself may be lower than the minimum minimum wage (allowed by law), if the total monthly income of the employee, taking into account all additional payments, is equal to the minimum wage. Attention! At the end of 2017, the Constitutional Court of the Russian Federation clarified that there are exceptions to this rule: northern regional coefficients and allowances cannot be included in the minimum wage. Since this violates the principle of social justice for citizens living in areas with severe natural and climatic conditions.
Other financial obligations of employers
In addition to maintaining salary compliance at a level not lower than the minimum wage, employers are also responsible for indexing wages. It is provided for in Art. 134 of the Labor Code of the Russian Federation and is based on the dynamics of consumer prices in the region of the company's operations. If the employer does not index wages in a timely manner, administrative sanctions may be applied to him.
So, about the need to conduct mandatory indexation of employees' salaries (moreover, backdating) in 2018, the Federal Tax Service for the Tambov Region informed all commercial organizations region. Since the analysis of tax and financial statements revealed numerous facts of violation of the rights of workers in the form of a lack of wage indexation in the presence of an obvious increase in the consumer price index in the region. Since 2018, such a key calculated value as the minimum wage has changed. The Ministry of Labor proposes to increase it in 2 stages. In 2018 - bringing up to 85% of the PM of able-bodied citizens. And in 2019, these two values will already be equal.
In December 2017, the State Duma adopted a corresponding bill. From January 1, 2018, the minimum wage is set at 9,489 rubles. And from January 1, 2019, it was planned that it would always be equal to the PM for the 2nd quarter of the year preceding the establishment of the minimum wage. However, already in January 2018, it was decided to increase the minimum wage to the level of the SM by May of this year. In February, the corresponding draft was adopted as a law by the Parliament of the Russian Federation.
Attention: the social assistance currently provided to certain categories of Russians will decrease as the minimum wage increases.
In the fall of 2018, the State Duma Committee on Labor and Social Policy approved a draft law on the annual increase in the minimum wage to the level of PM for the 2nd quarter of the previous year. Many personnel workers already know that from July 1, 2017, the federal minimum wage has been increased from 7,500 to 7,800 rubles. Cm. " ". Raising the minimum wage at the federal and regional levels
Since July 1, the minimum wage has been increased from 7,500 to 7,800 rubles. From this date on, the new minimum wage must be taken into account for calculating salaries and various benefits.
In addition to wages, the minimum wage affects three types of benefits:
- sick leave;
- on pregnancy and childbirth;
- caring for a child up to 1.5 years.
Note that the constituent entities of the Russian Federation (regions) are given the right to establish on their territory the amount of the minimum wage, which differs from the federal minimum wage (Article 133.1 of the Labor Code of the Russian Federation). The regional "minimum wage" is established by a tripartite agreement. It will be coordinated at the level of the government or administration of the subject (region, territory, autonomous region etc.), associations of trade unions and associations of employers. So, for example, from July 1, 2017, the minimum wage in Moscow increased to 17,624 rubles. Cm. " ".

ANSWER
From July 1, 2017, compare the payment for the month with the “minimum wage”, which is higher. The final amount must be in favor of the employee. At the same time, keep in mind that no less than the regional minimum wage should be the totality of all payments established for the employee that make up his salary (Article 129 of the Labor Code of the Russian Federation). That is, not only salary, but also compensation with bonuses.
It often happens that the regional minimum wage is higher than the federal one. However, in July 2017, the situation is not ruled out when the federal minimum wage is higher than the regional one. So, for example, in the Arkhangelsk region, the minimum wage is set for the whole of 2017 - 7,500 rubles per month, and the federal one from July 1 - 7,800 rubles. It turns out that from July 1 in the Arkhangelsk region, for calculations and establishing earnings, the federal minimum wage (7,800 rubles) must be taken into account.
What taxes are withheld if the salary is equal to the minimum wage
Some employers set the employee's salary clearly in accordance with the minimum wage (no more and no less). However, if the employee’s salary is equal to the minimum wage, personal income tax should still be withheld from it and insurance premiums, including "injury". This is confirmed by the law:
- personal income tax - articles 210 and 217 tax code RF;
- insurance premiums for mandatory pension (social, medical) insurance - articles 420 and 422 of the Tax Code of the Russian Federation;
- insurance premiums for insurance against industrial accidents and occupational diseases (“for injuries”) - articles 20.1 and 20.2 of the Law of July 24, 1998 No. 125-FZ.

Refusal of the regional minimum wage
The agreement on the regional minimum wage from July 1, 2017 becomes mandatory for application only for those who accepted it after publication in the media. After publication, the employer has 30 days to submit to the regional administration an application for waiving the use of the regional minimum wage. Increase in the minimum wage from July 1, 2017

So, for example, in the Arkhangelsk region, the minimum wage is set for the whole of 2017 - 7,500 rubles per month, and the federal one from July 1 - 7,800 rubles. Minimum wage and taxes
Some employers set the employee's salary clearly in accordance with the minimum wage (no more and no less). However, if the employee’s salary is equal to the minimum wage, personal income tax and insurance premiums, including “for injuries”, should still be withheld from it. This is confirmed by the law:
- personal income tax - articles 210 and 217 of the Tax Code of the Russian Federation;
- insurance premiums for mandatory pension (social, medical) insurance - articles 420 and 422 of the Tax Code of the Russian Federation;

We list the administrative fines under Article 5.27 of the Code of Administrative Offenses of the Russian Federation:
- for an official (for example, a director) - from 10,000 to 20,000 rubles;
- for an individual entrepreneur (employer) - from 1000 to 5000 rubles;
- for an organization (legal entity) - from 30,000 to 50,000 rubles.
If the organization commits a violation again, then the responsibility will be tougher:
- for an official (for example, a director) - a fine of 20,000 to 30,000 rubles.
- or disqualification for a period of one to three years;
- for individual entrepreneurs - a fine from 10,000 to 30,000 rubles;
- for the company - a fine from 50,000 to 100,000 rubles.
The issue of administrative punishment of violators is considered by the labor inspectorate or the court (parts 1, 2, articles 23.1, 23.12 of the Code of Administrative Offenses of the Russian Federation).
