And the inspector may well impose a fine under Article 12.5 of the Code of Administrative Offenses or even prohibit operation.

How do you check if the brakes are working?

To solve this problem, a technical inspection procedure has been introduced. As already mentioned, only the law can limit the rights, and the law on technical inspection will soon be adopted. While he is not there, the procedure established by the Government of the Russian Federation is in force (Article 4 of the law on amendments to the Code of Administrative Offenses of July 24, 2007), i.e. the Decree of the Government of the Russian Federation No. 880 of July 31, 1998 is in force. Orders of the Ministry of Internal Affairs were issued on its basis, and at present one should be guided by them.

The result of a technical inspection is a technical ticket - your carte blanche on the road from the inspector's encroachments on your stop to check the technical condition. According to Order No. 297 "Instructionon the work of traffic police "clause 13.9 , “It is not allowed to check the content of carbon monoxide in the exhaust gases of the engine and technical condition vehicles that have passed the state technical inspection in accordance with the established procedure.

But the traffic police service is not the only one in the traffic police. Control over the technical condition of vehicles is carried out by the technical supervision service. Its activities are regulated by Order No. 1240, which just records how this service implements control over the technical condition of vehicles on the road:

16.1 In the case of traffic supervision control over the design and technical condition of vehicles can be carried out at stationary posts and control posts of the police, checkpoints of vehicles.

16.2. The grounds for stopping vehicles to control the design and technical condition in the exercise of traffic supervision are:

othe absence in the lower right corner of the windshield of the car of a valid coupon for passing the state technical inspection;

othe presence in the designated places of vehicles of non-standard, unreadable or state registration plates installed with violations of the requirements of the Rules of the Road of the Russian Federation, as well as their absence;

othe presence of malfunctions and conditions stipulated by the Rules of the Road of the Russian Federation and the Basic Provisions for the Admission of Vehicles for Operation and Duties officials to ensure road safety, in which the operation of vehicles is prohibited.

Please note that "the presence of faults and conditions" is a reason to stop. Those. the fault must be detected before the shutdown, not after it. Otherwise, the stop is illegal, because. the order is violated, and as a result, the subsequent actions of the inspector are illegal. Therefore, if the inspector wants to check the handbrake, turn the steering wheel, see if the brake lights work, measure the light transmission of the windows, ask: “How did you determine this malfunction even before I stopped?”

These actions are also prohibited in the Code of Administrative Offenses:

Article 27.3 - to detain a driver is allowed for the consideration of a case or the execution of a punishment, but not for the detection of an event of an offense, as applied to the topic of the chapter for detection of a malfunction

Article 27.13, paragraph 1, paragraph 2 - the detention of the car is allowed after the discovery of the offense, and not before it.

Article 26.4, paragraph 4 - the examination is carried out after the protocol is drawn up.

Government Decree No. 880 states that only specially trained people can carry out technical condition checks, but the traffic police often ignore this requirement. The inspector is given a device for measuring light transmission and is given a plan according to the protocols for tinting.

The procedure for controlling a first aid kit, a fire extinguisher and a sign is similar. Their absence cannot be a reason for stopping, and the inspector has no right to check them after stopping. In addition, we can safely say that when leaving the garage, everything was in place. The first aid kit can be dismantled as a result of its use on the road, the fire extinguisher can also be used on the road for its intended purpose. These items are disposable. In addition, these items are not included in the list of clause 2.1.1 of the SDA and are not subject to presentation - this is not a driver's license. Since August 2007, the Code of Administrative Offenses has removed the ban on checking the technical condition of a car on the road. Since only a law can restrict freedom of movement, the amendments to the Code of Administrative Offenses state that a law on technical inspection will be adopted. While he is not there, the procedure established by the Government of the Russian Federation is in force (Article 4 of the law on amendments to the Code of Administrative Offenses of July 24, 2007). Those. To date, there have been no changes due to the lifting of the ban. To remove discrepancies, the easiest way is to be guided by the Orders of the Ministry of Internal Affairs. Until this ministry is born with new orders, police officers are forced to comply with the established order.

According to Order No. 297 "Manual on the work of the traffic police" clause 13.9. "It is not allowed to check the content of carbon monoxide in the exhaust gases of the engine and the technical condition of vehicles that have passed the state technical inspection in the prescribed manner."

But in the same place in paragraph 6.5.6 we read: “Prohibit the operation of vehicles if they have technical malfunctions that pose a threat to road safety (paragraph 23 of Article 11 of the Law of the Russian Federation “On Police”)”.


The decoding of these provisions is set out in Order No. 1240:

16.1 When supervising traffic, control over the design and technical condition of vehicles can be carried out at stationary posts and police checkpoints, checkpoints of vehicles.

If a malfunction does occur, then the inspector will begin to refer to the "List of malfunctions and conditions under which the operation of vehicles is prohibited." Redirect it to clause 2.3.1 of the SDA: “Before leaving, check and ensure the correct technical condition of the vehicle on the way in accordance with the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety.” And read him the sequel:

“It is forbidden to move if there is a malfunction of the service brake system, steering, coupling device (as part of a train), non-burning (absent) headlights and tail lights in the dark or in conditions of insufficient visibility, the windshield wiper is inactive on the driver’s side during rain or snowfall. If other malfunctions occur along the way, with which the operation of vehicles is prohibited by the annex to the Basic Provisions, the driver must eliminate them, and if this is not possible, then he can proceed to the place of parking or repair, observing the necessary precautions.

Those. suffice it to say that the malfunctions have just occurred, and the incident will be over. If, nevertheless, the protocol is drawn up, write down that you were refused to draw up a technical inspection report in the appropriate form (according to " methodological recommendations on the organization of the activities of the internal affairs bodies in the proceedings on cases of administrative offenses in the field of traffic "clause 8), and write down that you did not violate clause 2.3.1 of the traffic rules.

If the protocol is drawn up, indicate in it where you are going, and do not deviate from the route to the place of parking or repair. To suppress ongoing offenses, security measures are applied (Article 27.1 of the Code of Administrative Offenses), specifically in terms of technical condition - “prohibition of operation” with the removal of numbers (Article 27.13, paragraph 2 of the Code of Administrative Offenses). Since Article 12.5, Clause 1 of the Code of Administrative Offenses - driving a car in the presence of malfunctions - does not provide for a prohibition of operation, it does not apply to continuing offenses. Those. if you deviate from the route, any inspector can absolutely legally issue you as many fines as you like, because any start of movement in a faulty car will be a new offense.

If, when moving to the place of repair (for example, the next day), a protocol is drawn up against you again, then write “I do not agree, I am following to Chelyabinsk-Lada Molodogvardeytsev, 2.” And during the consideration of the case, attach copies of the receipt for car service services to the case. It is better when drawing up the first protocol to apply for permission to move to a car service.

After 07/01/08, it is officially allowed to drive for one day without a second fine. To the offer to use the services of a tow truck, you answer that there are not so many large cities in Russia, in many small towns there are no tow trucks at all, and there is no other way to get to MOT except on your own. Why is it necessary to make an exception for a city where there is a tow truck? Or is it necessary to make the rights of a citizen dependent on the place of residence? So it is prohibited by the Constitution.

If the inspector tries to escort you to the maintenance station to check the technical condition, then this is your right, not your obligation. Your constitutional right - to move freely on the territory of Russia - is enshrined in the law "On Road Safety", Article 24, Clause 3, Part 1. And no law stipulates that it can be limited to sending to a TO station (Article 5 of the law “On Police”). The Code of Administrative Offenses does not provide for such a security measure. Those. on the part of the inspector, such a requirement is illegal, and your disobedience to him does not comply with Article 19.3 of the Code of Administrative Offenses (see “You are being detained”).

The "divorce" with the direction to the TO station begins with the fact that the inspector detains you or your car on suspicion of committing an offense. And then it makes a determination on the examination and sends it to the maintenance station to identify a malfunction, and, accordingly, to identify an offense. He has a mess in his head, he is not able to distinguish between an examination under the Code of Criminal Procedure, when a car can be detained for a fake body number, and an examination under the Code of Administrative Offenses, which is carried out when the case is already in production, i.e. the protocol was drawn up (Article 26.4, Clause 4 of the Code of Administrative Offenses). See also Article 27.13, Clause 1 and Clause 2 of the Code of Administrative Offenses. In these points, the detention of the car is allowed after the discovery of the offense, and not before it.

Moreover, for ordinary malfunctions, for which punishment is provided for in Article 12.5, paragraph 1 of the Code of Administrative Offenses, detention is not provided at all. Similarly, with the detention of a citizen: according to Article 27.3 of the Code of Administrative Offenses, it is possible to detain after the discovery of an offense, and detention for the detection of an offense is not provided. If the inspector puts before a choice: either to the TO station, or to the cell on the basis of Article 19.3 of the Code of Administrative Offenses - disobedience to a police officer, then of course, it is better to go to the TO station. But when you part with him, you should definitely file a complaint with the court, otherwise the next day everything can happen again - impunity spoils people.

ABOUT THE CONTROL AND TECHNICAL POINT

1. General Provisions

1.1. This Regulation establishes the requirements for the control and technical point, its material and technical base, the list of operations for inspecting the technical condition of vehicles.

1.2. The control is carried out to prevent the admission to work of technically faulty vehicles.

1.3. Responsibility for organizing the work of the control and technical point rests with the chief engineer of the enterprise, economy.

1.4. When vehicles are temporarily assigned to individual production sites, the responsibility for the technical condition rests with the heads of these sites.

2. Requirements for the control and technical point and its

material and technical base

2.1. A control and technical point (CTP) is organized at machine yards, garages, motor transport enterprises and other storage areas.

2.2. The control and technical point should consist of a room for a mechanic, a platform with a hard surface for checking the operation of the brake system, an inspection pit, as well as a gate for the entry and exit of equipment.

2.3. The mechanic's room should be:

a list of all vehicles registered with the enterprise;

work schedule of vehicles by time of day, approved by the head of the enterprise;

operational and technological maps of vehicle inspection;

samples of registration of waybills, a mechanic's journal (Appendix 1);

a cabinet for placing a set of tools and accessories in it (Appendix 2);

table, chair, stationery and clock;

means for informing drivers and machine operators about adverse weather conditions;

job description of the mechanic of the control and technical point;

heating and lighting.

2.4. At the KTP, the presence of a certificate for the right to drive a vehicle is checked, waybills and other documentation. If deviations are detected, the vehicle is delayed. About malfunctions and inaccuracies in the record, the mechanic makes a note in the log (Appendix 1).

2.5. The KTP mechanic organizes technical assistance, and, if necessary, towing the vehicle to the parking lot, upon receiving a message about a vehicle malfunction on the line, establishes the cause of the malfunction, determines the nature and extent of repair work.

2.6. When returning a vehicle with external damage to the KTP, an act is drawn up in the form (Appendix 3). It is submitted for approval to the chief engineer of the economy and is the basis for filing a material claim against the culprit. The fact of damage to the vehicle is reported to the traffic police.

3. Control over the technical condition of vehicles

3.1. During the inspection of vehicles at the checkpoint, the mechanic checks:

completeness of the vehicle, its condition, appearance facings of a radiator, a body (cabin and platforms);

no leakage of oil, fuel, water, brake fluid;

condition of steering rods and ball joints, cables, hoses, pipelines, brakes, frame and springs, tires, hitch, lighting and windshield wipers;

availability and completeness of a first aid kit, fire extinguisher, sign emergency stop, means personal protection drivers when transporting dangerous and harmful substances special vehicles.

3.2. On vehicles for the transport of flammable substances, the presence of two foam fire extinguishers, sandboxes, shovels and felt mats, serviceability of grounding and plating of hoses.

3.3. On vehicles for transporting people, the absence of foreign objects in the passenger compartment, the serviceability of lighting, the correct fixing of benches, the serviceability of door and hatch locks, the presence of a ladder, and the installation of a two-way alarm system are checked.

3.4. The brake system is checked for:

vehicle and trailer braking efficiency;

uniform braking of all wheels;

air tightness and hydraulic system brakes;

pressure gauge operation of the manufacturer's design system;

parking brake operation.

3.5. Steering checks:

the amount of play of the steering wheel;

ease of rotation of the steering wheel;

reliability of fastening of the steering wheel column, steering gear housing and cotter pins of the joints of parts;

power steering operation.

3.6. Tires are checked for:

tread wear;

compliance of tires in size and permissible load;

tread integrity;

convergence of steered wheels;

reliability of fixing the wheels on the hub;

tire pressure;

the presence of foreign objects between the dual tires.

3.7. On the engine and transmission are checked:

compliance of the engine with the manufacturer's design;

muffler serviceability;

tightness of the fuel system;

ease of engaging the gearbox gear without difficulty and noise, spontaneous disengagement of gears and slipping of the clutch;

devices for suppressing radio interference;

vibration and fastening of the driveline.

3.8. For other structural elements, the following are checked:

seals of speedometer equipment;

traction-coupling and supporting-coupling devices of tractors and trailer links, as well as safety cables provided for by their design;

operability of door locks, constipation of the boards of emergency exits;

the presence of a rear-view mirror, sound signal;

installation of decorative equipment that reduces visibility from the driver's seat;

windshield wiper and washer;

external and internal lighting fixtures.

3.9. When sending vehicles on a business trip for more than a day at the KTP, the following are additionally checked:

serviceability of locks of doors of a cabin or a body;

serviceability of constipation of the sides of the cargo platform;

operation of the driver's seat adjustment mechanism;

emergency exits and devices for their activation;

operation of an emergency stop signal or the presence of an emergency stop sign;

operation of the windshield heating and blowing device;

the presence of mud-proof aprons and mudguards;

recoil devices (at least two);

serviceability of windshield washers and wipers;

the presence of a towing cable, a chance tool and other means provided for the carriage of goods.

Control inspection of the car before leaving the park

A control inspection of the car before leaving the park is carried out in order to check its technical condition and identify and eliminate the detected malfunctions. The inspection is carried out by the driver after receiving the necessary travel documents before leaving for the flight.

The control inspection takes an average of 15 to 20 minutes, depending on the practical skills of the driver, the brand of the car and its technical condition.

The driver begins the control inspection of the car by checking its appearance, cleanliness and condition of the outer surfaces, after which, in a strictly defined sequence, it checks the technical condition of the components, assemblies and mechanisms of the car. The following test sequence is recommended:
I - cab, steering, signals, clutch, brakes, batteries, left footboard and fender of the car;
II - front wheels and tires, front suspension, winch, headlights and sidelights;
III - engine;
IV - right fender and footboard, cab doors and lining, spare wheel, fuel tank, body, muffler, cardan joints, gearbox (with divider), transfer case, parking brake, air tanks;
V - rear axle, balancer hubs, jet and push rods, rear springs, wheels and tires, body platform, fifth wheel, rear lights, direction indicators, traction stage device;
VI - left side of the body, fuel tank, wheels and tires.

During the control inspection, the completeness and serviceability of the driver's and entrenching tools and other personnel equipment, and, if necessary, a portable set of spare parts, must be checked. For a quality control inspection of the car, it is recommended to use a driver's tool kit. When inspecting parts such as fenders, cab doors, footrests, etc., it is not necessary to check the tightness of each bolt and nut. To do this, it is enough to “shake” these details with a certain effort. If they are not securely fastened enough, you will feel their free movement. It is advisable to check the reliability of the fastening of the axle shafts, balancer covers, etc. with the help of wrenches, and the wheels - with light blows of the tao hammer on the side faces of the nuts.

During the control inspection, the driver must check the presence of fuel in the tanks, oil in the engine crankcase, coolant in the radiator or expansion tank, turning Special attention on fitting connections of highways and the absence of stains of liquid (coolant or brake), oil, fuel on the floor (ground, snow). The operation of the steering, clutch, brakes, gearbox and transfer case, drive axles are usually checked while the car is moving.

Inspection of the car on the way

The control inspection of the car on the way is carried out in order to prevent and timely eliminate the identified malfunctions.

Usually, on the way, the technical condition of the car is checked according to the readings of instrumentation and a thorough inspection of the car at halts and stops.

The control inspection is carried out immediately after stopping the car. At the same time, the following volume and sequence of work to be performed are recommended.

1. ‘Check by touch; the degree of heating of the wheel hubs and brake drums, cardan joints, gearbox housings (divider), transfer case and drive axles. In this case, heating is considered normal if it does not cause a sensation of burning the palm of the hand.

2. If necessary, clean the license plates and identification marks, rear light glass with sidelights, parking lights, windshields and cab door glass.

3. Make sure there are no leaks of oil, fuel, coolant, brake and shock absorber fluids.

4. Check the oil level in the crankcase, coolant in the radiator and fuel in the tank.

5. Check the presence and tightening of the wheel nuts, the condition of the tires, springs, shock absorber mounting, the condition and presence of cotter pins in the steering and brake drive rod connections, the air pressure in the wheel tires (if necessary, bring to normal).

6. Make sure that the brake light and rear light are in good condition, as well as check the fastening of the side locks and the serviceability of the towing device, securing the load and the technical condition of the trailer.

Malfunctions detected by the control inspection must be eliminated independently or with the involvement of technical assistance.

Daily maintenance is the main type of car care. It is carried out after returning to the park in order to prepare the car for the upcoming flight. When performing daily maintenance, it is recommended to do the following: .

1. Upon returning the car from the trip, it is necessary to immediately check the heating of the wheel hubs, brake drums, gearbox housings (divider), transfer case, drive axles and, if increased heating is detected, find and eliminate the causes yourself or with the help of specialists at the technical point service.

2. By external inspection, make sure that there is no damage to the body, cab, doors, headlights, sidelights, rear lights, license plates, as well as leaks of fuel, oil, cooling, brake and shock absorber fluids, air leaks from the pneumatic system. Traces of leaks are easier to detect before washing the car on dusty units or car components. These traces are outward signs vehicle malfunctions that need to be detected and repaired.

3. Check the amount of fuel in the tank, the oil level in the engine crankcase and power steering reservoir, coolant in the radiator or expansion tank and top up to normal. It must be borne in mind that fuel tanks should be filled without waiting for them to cool down; Otherwise, water may condense, which will affect the operation of the engine.

4. Clean the car from dirt, dust, snow, wash it if necessary, Wipe the windows, plumage, headlights, sidelights, license plates and identification plates. 6. If the car worked in a very dusty area, then you should remove the engine and compressor air filters, disassemble, wash their parts and change the oil, setting the required level.

7. Check the amount of play of the steering wheel (for vehicles with power steering, this operation should be carried out with the engine running), the reliability of fastening of the bipod, steering rods, brake drive and clutch pedal, drain the condensate from the air cylinders (drain only if there is air in the system ).

8. Check the condition and operation of the brakes, steering, lighting, alarms and wipers.

9. Check the reliability of the fastening of the batteries, wipe them from dust, check the connection of the wires at the terminals.

10. Check the condition of the cardan shafts, the fastening of their flanges and the condition of the springs, shock absorbers, towing hitch.

11. Check the condition of the tires, the air pressure in the tires and the tightness of the wheel nuts.

12. Lubricate the components and mechanisms of the car in accordance with the lubrication map.

13. Check the presence, condition and laying of the winch cable, entrenching tool, driver's tool, spare wheel, accessories, personal property and means of increasing patency. The technical condition and appearance of a car that has undergone maintenance and is leaving for a flight must meet the following requirements:
