Compliance of products with the requirements of technical regulations is confirmed

Confirmation of compliance procedure, the result of which is documentary evidence that products, processes, works or services comply with the established requirements of the TR or the provisions of standards, the conditions of civil legal contracts. Grade compliance can be carried out in forms state control, accreditation, testing, registration, conformity assessment, acceptance and commissioning of the completed construction facility. Confirmation Objects: products, processes (methods) of production, operation and disposal, works and services, quality systems, environmental management systems, general principles and characteristics. Confirmation form: Conformity assessment on the territory of the Russian Federation may be voluntary or mandatory. Voluntary confirmation of conformity is carried out in the form of voluntary certification. Mandatory confirmation of conformity is carried out in the following forms: acceptance of a declaration of conformity (hereinafter referred to as the declaration of conformity);

mandatory certification. The procedure for applying the forms of mandatory confirmation of conformity is established by this Federal Law. Conformity assessment is developed and applied regardless of the country and place of origin of products, implementation of processes, performance of work and provision of services, types or features of transactions and (or) persons who are manufacturers, performers, sellers, purchasers.

Goals: certification of compliance of products, processes, works, services or other objects with technical regulations, standards, codes of practice, terms of contracts; assisting consumers in the appropriate choice of products and services; increasing competitiveness in the Russian and international markets; creating conditions for ensuring the free movement of goods across the territory of the Russian Federation, as well as for the implementation of international economic, scientific and technical cooperation and international trade. Principles: availability of information on the procedure for the implementation of conformity assessment to interested parties; the inadmissibility of applying mandatory confirmation of conformity to objects in respect of which the requirements of technical regulations are not established; establishing a list of forms and schemes for mandatory confirmation of conformity in relation to products in the relevant technical regulation; reducing the time for the implementation of mandatory confirmation of conformity and the costs of the applicant; inadmissibility of coercion to carry out voluntary confirmation of compliance; observance of trade secrets in relation to information obtained in the course of conformity assessment; inadmissibility of substituting mandatory confirmation of conformity with voluntary certification.

45. Voluntary confirmation of conformity (voluntary certification). Systems and certification schemes.

Voluntary confirmation of conformity is carried out in order to increase the buyer's confidence in products, increase the competitiveness of products and services in the market. Voluntary confirmation of conformity is carried out only in the form of voluntary certification. Voluntary confirmation compliance is carried out at the initiative of the applicant on the terms of the contract between the applicant and the certification body. Voluntary confirmation of conformity can be carried out to establish compliance with national standards, standards of organizations, voluntary certification systems, and the terms of contracts. The objects of voluntary confirmation of conformity are products, processes of production, operation, storage, transportation, sale and disposal, works and services, as well as other objects for which standards, voluntary certification systems and contracts establish requirements.

Certification body: carries out confirmation of conformity of objects of voluntary confirmation of conformity; issues certificates of conformity for objects that have passed voluntary certification; grants applicants the right to use the mark of conformity, if the use of the mark of conformity is provided for by the relevant system of voluntary certification; suspends or terminates the certificates of conformity issued by him. A voluntary certification system can be created legal entity and an individual entrepreneur or several legal entities and individual entrepreneurs.

The person or persons who created the voluntary certification system establish a list of objects subject to certification and their characteristics, for compliance with which voluntary certification is carried out, the rules for performing the work provided for by this voluntary certification system and the procedure for their payment, determine the participants in this voluntary certification system. The voluntary certification system may provide for the use of a mark of conformity. The voluntary certification system may be registered by the federal executive body for technical regulation.

Compliance is confirmedin order to :

Certification of conformity of products, production processes, operation, storage, transportation, implementation and disposal of works, services or other objects of TR, standards, terms of contracts;

Assistance to purchasers in the competent choice of products, works and services;

Increasing the competitiveness of products, works, services in the Russian and international markets;

Creation of conditions for ensuring the free movement of goods across the territory of the Russian Federation, as well as for the implementation of international economic, scientific and technical cooperation and international trade.

When making a decision on confirmation of conformity, it is necessary to be guided by the followingprinciples :

1. availability of information on the procedure for carrying out conformity assessment to interested parties;

2. the inadmissibility of applying mandatory confirmation of conformity to objects for which requirements are not established technical regulations;

3. establishing a list of forms and schemes for mandatory conformity assessment for certain types of products in the relevant regulations;

4. reduction of the terms for the implementation of mandatory confirmation of compliance and the costs of the applicant;

5. inadmissibility of coercion to carry out voluntary confirmation of compliance;

6. the inadmissibility of replacing the mandatory confirmation of compliance with voluntary certification;

7. protection of the property interests of applicants, observance of trade secrets in relation to information obtained in the course of conformity assessment.

It should be emphasized that these principles declare:

On the openness and availability of information on all issues related to the confirmation of compliance for all stakeholders(principle 1);

Inadmissibility of coercion to carry out voluntary confirmation of conformity, if this is not necessary (principle 2), and thus the transformation of a voluntary certification procedure into a mandatory one (principles 5 and 6);

Minimization of time and costs in carrying out work on confirmation of compliance (principle 4), as well as observance of trade secrets (principle 7);

Mandatory availability of schemes and forms of conformity assessment (principle 3).

5.4. Compliance Forms

Compliance Form- a certain procedure for documentary certification of the conformity of products or other objects at all stages of their life cycle, the performance of work or the provision of services to the requirements of TR, the provisions of standards, sets of rules or the terms of contracts.

Confirmation of conformity differs not only in form and content, i.e. may have different validation schemes.

Compliance Scheme- a list of actions of participants in conformity assessment, the results of which are considered by them as evidence of the conformity of products and other objects with established requirements (Section 5.8.).

On the territory of the Russian Federation, confirmation of conformity can be voluntary or required character (Fig.5.1.):

voluntary conformity assessment carried out in the form of voluntary certification.

obligatory confirmation of conformity carried out in the form:

Acceptance of a declaration of conformity (declaration of conformity);

Mandatory certification.

The procedure for applying the forms of mandatory confirmation of conformity is established by the Federal Law "On Technical Regulation".

So, in the conformity assessment system, two main forms of confirmation are introduced: voluntary and mandatory. What is their difference and what products (works, services) - objects of certification, can and should be certified? What form of confirmation of conformity to choose for a particular object of certification and who chooses this form? Does the form of confirmation of conformity depend on the object of certification? What are confirmation schemes for and why are they different? Are different forms of certification equal? We need answers to these and other questions.

It should be noted that the certification of products (works, services) is rather complicated. This is due to the fact that three parties (Applicant, Consumer and OS) are involved in the process of conformity assessment, and the certification objects themselves are extremely diverse: products (food products, medicines, industrial products, high-risk products, military products, equipment for various purposes, etc.). ), works, services, quality systems, jobs, etc.

It must be emphasized that confirmation of compliance with federal law "On technical regulation" is considered as the compliance of the characteristics of the object of certification with the requirements of TR. However, during the transitional period, when in a number of areas of industrial activity, certification of homogeneous products has not yet been put into effect (relevant TRs have not been developed), conformity assessment is carried out using the existing ND, the list of which is determined, as a rule, by the system of certification of homogeneous products. Therefore, below, if the text refers to confirmation of compliance with the requirements of TR, then this is true if these regulations have been developed by now.
