Worried about this state of affairs, the authorities are adopting laws that are called upon by a strong-willed decision to limit opportunities to purchase alcoholic beverages, and the main one that establishes such temporary restrictions is Law 171-FZ of November 22, 1995.

Law prohibiting the sale of alcohol.

According to paragraph 7 of Article 2 of Law 171-FZ, the following drinks are considered alcoholic, which contain more than 0.5% ethyl alcohol (calculated from the volume of the finished product), such as vodka, mead, wine (including sparkling, liqueur or fruit) and wine products, beer, as well as drinks made on its basis, cider.

The rules for the retail sale and consumption of alcoholic beverages are contained in Article 16 of Law 171-FZ. Retail trade under these rules is prohibited:

In those institutions that work with children, education, sports and medicine, as well as near them.
In cultural institutions (with the exception of the sale of low-alcohol drinks by catering enterprises).
In urban and suburban public transport, at bus stops.
At train stations, markets, gas stations, mobile retail outlets, airports, as well as other public places or near them.

According to the law 171-ФЗ, paragraph 5 of article 16, restrictions are imposed not only on the places of retail sale of alcoholic beverages, but also on the time when it can be purchased, the sale of alcohol is prohibited during hours - from 23.00 to 8.00. However, this rule does not apply to duty-free trade and public catering organizations. At the same time, the law gives regional authorities the right to provide for their own temporary restrictions on the sale of alcohol to the public.

Some regions of the Russian Federation have established such time frame for the sale of alcoholic beverages:

Moscow. Prohibition on the sale of alcohol according to the law 171-FZ, it is established from 23.00 to 08.00.
Moscow region. You can not sell alcohol from 21.00 to 11.00.
St. Petersburg. There is a ban from 22.00 to 11.00.
Tula region. It is allowed to sell alcohol from 14.00 to 22.00

Chechen Republic. The conditions for the sale of alcohol here are even tougher: alcoholic beverages can be purchased only two hours a day - from 8.00 to 10.00.

As you can see, on the territory of many of the regions of Russia there are even more strict prohibition time frames than those established in the law 171-FZ, but these restrictions do not apply to restaurants and cafes in these regions, however, they apply to take-away sales.

Days of the ban on the sale of alcohol 2016.

The law also allows the regions to establish their own restrictions on the conditions and places of alcohol retailing. The regions of the Russian Federation took advantage of this opportunity and in many areas there were their own restrictions, when the sale of alcohol to citizens is prohibited throughout the day, and these are:

May 25 - the end of school studies, as well as the days of school graduation balls;
June 1 - Children's Day;
June 27 - Youth Day;
1 September is the day of knowledge;
and September 11 - Sobriety Day.

These days, the sale of alcoholic beverages is completely prohibited in the Saratov and Pskov regions, and in the Ulyanovsk region these days are also added:

When can you sell and buy alcohol

The ban on unrestricted night-time sales of alcohol is introduced for several purposes:

to reduce the general alcoholization of Russians;
reduce the consumption of alcoholic beverages per capita of the adult population of the country;
reduce the purchase of alcohol (including soft drinks - cocktails and similar - and beer) by minors, adolescents and young adults;
to prevent the growth of offenses at night, including those committed while intoxicated.

Law on the sale of alcohol №171-FZ was accepted November 22, 1995. It has been repeatedly amended, but the main provisions are enshrined in this legislative act.

Article 2 The law determines which drinks should be considered alcoholic. All liquids containing more than 0.5% ethyl alcohol are considered to contain alcohol. These include both strong (cognac, vodka, rum, brandy and others with a strength of 40% by volume and above) products, as well as wines and wine products, as well as beer and all drinks made on its basis. The category of alcoholic beverages does not include non-alcoholic beer, the strength of which is usually up to 0.5%.

Article 16 This Act determines where and when you can sell and buy alcohol. According to the rules, alcohol can only be sold in the Russian Federation from 8:00 am to 11:00 pm. Moreover, all retail outlets, with the exception of catering establishments, must adhere to this law.

Nevertheless, the law provides that each subject of Russia can introduce its own regional rules for the sale of alcohol, which do not contradict the basic norms. For example, if in Moscow alcohol is sold only at the time prescribed by law, then in the Moscow region additional norms have been introduced, according to which the sale of alcoholic products is possible only from 11-00 to 21-00. In Khabarovsk, you can buy alcohol-containing products from 10-00 to 22-00, while in the Khabarovsk Territory - from 8-00 to 22-00. The question of how much alcohol is sold at is left to the discretion of the administration of regional and municipal entities. Among young people, the question is especially relevant, and how long they sell beer. Until January 1, 2013, this intoxicating drink, along with other low-alcohol drinks (strength up to 5% vol.), was allowed to be sold to the population at night. However, since the beginning of 2013, it has become impossible to buy beer after 23:00.

The Law does not apply to organizations engaged in the retail sale of alcohol at catering establishments. These include restaurants, cafes, bars and other establishments where the sale of alcoholic beverages is allowed around the clock. However, certain requirements are imposed on such outlets. Such an enterprise must have an appropriate license for the right to sell alcohol, in addition, alcohol cannot be sold for takeaway: it is allowed to sell it only on tap, and the buyer must consume all purchased alcohol inside the establishment. For non-compliance with the rules, laws provide for administrative liability.

Everyone involved in the alcohol trade should remember the responsibility for trading at unspecified times. In the event that law enforcement agencies establish the sale of alcohol at unspecified hours, administrative fines may amount to:

for legal entities - from 30 to 40 thousand rubles with confiscation of products;
for individual entrepreneurs and officials - from 3 to 4 thousand rubles with confiscation.

The law also provides for liability for the sale of alcohol via the Internet at the wrong time. In addition, if several cases of alcohol sales in one outlet are recorded in a year, the punishment may be more serious - up to the revocation of the license and the possible closure of the store.

Sale of alcohol to minors

This law on the sale of alcohol to minors contains instructions not only on how and until what time you can sell alcohol in Russia. Legislators also consider the fight against teenage and youth drunkenness to be an important task. Residents of Russia know from the school bench that the sale of alcohol to minors is prohibited.

In the Russian Federation, the age of majority comes at the age of 18. In some regions, by-laws have been passed prohibiting the sale of alcohol to persons under 21 years of age.

Regardless of the age of the buyer of alcohol, the seller has the right to demand an identity document from him. This authority was introduced by the article of the Law of the Russian Federation of July 18, 2011 No. 218. If the age of the buyer is in doubt, and he does not have a passport, the seller has the right to say - I will not sell.

Responsibility for the sale of alcohol to minors can be borne by both the seller who sold the goods to the teenager and the owner of the outlet. As a rule, these are administrative fines, the amount of which is determined in each individual case. Individuals can pay from 3 to 5 thousand rubles, officials - from 10 to 20 thousand rubles, legal entities - from 80 to 100 thousand rubles.

Every merchant should know how old they have been selling alcohol. In addition, in any self-respecting outlet where alcohol is on sale, there should be a corresponding warning about how old you can buy alcohol.

In order to prevent the illegal sale of alcohol to teenagers, interested persons or eyewitnesses can report to law enforcement agencies about the sale of alcohol to minors in a particular outlet. Video footage should also be provided if possible. Police officers, together with employees of Rospotrebnadzor and representatives of the media, regularly conduct control raids, often with the participation of a minor, to detect and stop such actions.

Places where alcohol is sold

Articles of the Law provide for places where the retail sale of alcohol is completely prohibited, regardless of the time of day.

A complete ban on alcohol is put:

in all medical institutions;
in any educational institutions;
in places of sports, cultural and leisure orientation;
at public transport stops and in the transport itself;
at stations, markets, gas stations, mobile retail outlets, airports (except duty-free zones), as well as other public places or near them.

The fact that alcohol is not a place here, there may be appropriate signs in the institutions.

Days of a total ban on alcohol

In order to improve the criminal situation, the sale of vodka and other alcoholic beverages is completely prohibited for several days a year. To enable the underage population of the country to celebrate some school holidays without alcohol, it cannot be bought on September 1 - Knowledge Day and May 25 - Last Bell Day. Moreover, alcoholic beverages are not sold on this day to the adult population.

In many regions, the ban on alcohol exists on June 1 - Children's Day and June 27 - Youth Day. On this day, alcohol is not sold until 00:00 the next day.

Laws restricting the sale of alcohol at night exist in many countries around the world. Over the years of the existence of the Law in Russia, it was possible to achieve certain results that legislators had hoped for. The alcoholic culture of the population is gradually formed. As recent statistics show, the total amount of alcohol consumed in the country is steadily declining. The consumption of beer and low-alcohol products has grown, while strong drinks have become less popular. The number of crimes committed at night while intoxicated has decreased.

To combat alcoholism, Russian deputies introduced a ban on the sale of alcoholic beverages at night in stores. The authors of the law claim that the restriction has reduced the level of crime and alcohol consumption per person. But at the same time, the innovation caused a lot of trouble for ordinary citizens, since the hours of selling alcohol in different regions of the Russian Federation are different.

Paragraph 5 of Article 16 of the Federal Law of November 22, 1995 N 171-FZ (as amended on November 2, 2013) “On state regulation of the production and circulation of ethyl alcohol, alcoholic and alcohol-containing products and on limiting the consumption (drinking) of alcoholic products” establishes the following restrictions: “Retail sale of alcoholic products from 23:00 to 08:00 local time is not allowed, with the exception of the retail sale of alcoholic products carried out by organizations, and the retail sale of beer and beer drinks, cider, poiret, mead, carried out by individual entrepreneurs, when provided by such organizations and individual entrepreneurs of catering services, as well as the retail sale of alcoholic products carried out by duty-free shops.

The state authorities of the constituent entities of the Russian Federation have the right to establish additional restrictions on the time, conditions and places for the retail sale of alcoholic products, including a complete ban on the retail sale of alcoholic products.

This means that at retail outlets (shops and supermarkets) in Russia, alcohol is sold to adult citizens from 8 am to 11 pm local time, but only if the administration of the subject of the federation has not introduced more stringent restrictions.

For example, as of April 2014, the hours of alcohol sales in Moscow coincide with the all-Russian ones - you cannot buy alcohol after 23:00 and before 8:00 in the morning. But in the Moscow region there is a stricter restriction - shops are not allowed to sell alcoholic beverages from 21:00 to 11:00. In St. Petersburg, alcohol can be bought from 11:00 to 22:00, in Novorossiysk - from 9:00 to 22:00. Therefore, from what time they sell alcohol in your city, it is better to check with the local authorities or the administration of stores that sell alcohol in the region.

The restrictions do not apply to catering places (cafes, bars) and duty-free shops (Duty Free at airports and train stations), where alcohol is sold around the clock. Until January 1, 2013, the night sale of beer and drinks with a strength of up to 5 degrees was allowed, but now their retail sale at “inappropriate” hours is also prohibited.

For the sale of alcohol at a prohibited time, the company will pay a fine of 50-100 thousand rubles, and its head - 5-10 thousand rubles. The responsibility of citizens is not provided 🙂

Interestingly, the legislation now allows local administrations to impose a complete ban on the sale of alcohol. In the Vladimir region on December 31, 2013, by an official decree, the governor banned the sale of alcoholic products, the strength of which exceeds 16.5%. That is, only wine and beer should have remained on the shelves.

But the population did not share the initiative of their leader. On January 9, 2014, the ban was lifted, the “semi-dry law” lasted only 10 days. Then the officials explained that a mistake had crept into the text of the decree. Initially, it was planned to limit only the night sale of alcohol from 21:00 to 9:00, but they forgot to add this phrase, in fact, introducing a complete ban on the sale of strong alcohol just before the New Year and Christmas.

Since 2012, federal legislation (clause 9, article 16 of the Law "On State Regulation of the Production and Turnover of Ethyl Alcohol ..." No. 171-FZ dated November 22, 1995) has established that the sale of any alcohol is prohibited throughout Russia in the period from 11 pm until 8 am. However, the same law states that local authorities can establish their own, even more stringent, standards - and here everything depends on the position of the regional authorities.

The fantasy of legislators at the level of the constituent entities of the Russian Federation (and Moscow as a city of federal significance, like St. Petersburg and Sevastopol, is not just a city, but a separate entity at the level of a region or a republic) can run wild. For example, in the Belgorod Region it is forbidden to sell alcohol from 10 p.m. to 10 a.m. (clause 1 of Article 2 of the Law of the Belgorod Region dated April 28, 2016 No. 71), in the Moscow Region - from 11 p.m. to 8 a.m. on the basis of federal legislation (previously established by the law of the Moscow Region dated 04/27/2012 No. 40/2012-OZ, the time limit from 21 to 11 was canceled), in Arkhangelsk - from 21 to 10 in the morning, and on some days (September 1, Children's Day, graduation days and youth day) even from 13:00 to 10:00 the next day (paragraph 1 of the Decree of the Government of the Arkhangelsk Region dated 05.06.2012 No. 222-pp).

In other regions, of course, their own restrictions may also be adopted. Therefore, if you are going on a visit to another city, ask in advance what time you can buy alcohol there.

From what time is the ban at night on the sale of alcohol in Moscow

In Moscow itself, a federal norm is still in force - a ban on the sale of alcohol from 23:00 to 08:00 the next day. However, even from these norms there are exceptions - and also at the all-Russian level.

All the same federal law No. 171-FZ directly states that these norms apply only to the retail sale of alcohol and do not apply to restaurants, bars, pubs and other places formally classified as public catering establishments. For them, you need to take into account other rules, according to which sales are allowed after 23:00:

strong alcohol - only for legal entities;
beer, mead, low-alcohol drinks - to entrepreneurs too.

In addition, the requirements of the law do not apply to duty free shops operating at airports - alcohol is sold there around the clock. However, only air passengers can use these shops.

Where the sale of alcohol in Moscow is absolutely prohibited

In Moscow, as in all of Russia, alcohol is never sold:

near children's, medical and sports facilities;
in cultural organizations (with the exception of buffets and other food outlets operating under these organizations);
at railway stations, airports and other places where there is both a mass gathering of citizens and an increased danger from transport (this does not only apply to the sale of alcoholic beverages in cafes / bars at railway stations and the already mentioned duty-free shops);
at military installations and territories adjacent to them;
in stalls, tents and other commercial facilities that are not stationary.

In addition, it is prohibited anywhere and at all times to sell any alcoholic beverages to minors. The seller, if he has doubts, has the right to demand a document confirming the identity and age from any buyer. Moreover, even if a minor looks older than his age and the seller will release alcohol to him, this will still be a violation of the law.
