Let's talk about how to competently draw up a technical task for the purchase of consumables for electronic computing and other equipment using the example of the purchase of cartridges for printers.

It is known that consumables for electronic computers require regular replacement, unlike the EWT products themselves. Most often, customers require consumables for printers, multifunction devices and copiers (CMA) . Such consumables are, as a rule, various cartridges and toners.

Below is a sample Terms of Reference for the purchase of cartridges, using which the state customer, during an open auction in electronic form, achieved a reduction in the initial (maximum) contract price from 800,000 to 180,000 rubles, i.e. by 77.5%. At the same time, 16 participants in placing an order took part in the auction in electronic form.

Sometimes customers specify special requirements for cartridges in the auction documents, such as avoiding streaks when the toner level is low (requirement for the operation of the helicoidal drive mechanism), securely locking and fixing the toner in the cartridge to prevent leakage (requirement for magnetic seals) , as well as the requirement for print density and background density, measured by a densitometer.

Also, the customer has the right to establish requirements for packaging and labeling of consumables. So, for example, it is possible to indicate the factory packaging of the consumable, if this is necessary for the customer. The general formula for packaging and labeling requirements for consumables is usually as follows. Packaging and labeling of goods must comply with the requirements of GOST, imported goods - international packaging standards. Packaging and labeling of consumables must contain all signs of originality established by manufacturers, authenticity marks, holograms, security seals, stamps containing all elements of protection against counterfeiting (inscriptions and sticker color that change at different viewing angles, a unique sticker number, a barcode on the sticker , thermal strip, etc.), contain all the necessary codes and signs of the manufacturer, not have mechanical damage.

The body of the cartridge must not have scuffs, scratches, chips and traces of opening. Packaging should ensure the safety of the goods during transportation to the final place of operation and loading and unloading. The labeling of the packaging must strictly correspond to the labeling of the goods.

Further, the customer has the right to indicate the operability of cartridges, which, for example, should guarantee trouble-free operation of office equipment with minimal user intervention, if necessary. Typically, customers want a product that combines quality, high performance printing with a reliable and easy-to-use design, as well as easy installation and maintenance.

If ease of use is key, this should also be stated in the Terms of Reference. As with the purchase of other goods used in the daily activities of the customer, an integral part of the Terms of Reference for the purchase of cartridges and other consumables are the requirements for the warranty period for servicing the goods: the warranty period for the normal functioning of the goods, subject to proper storage or until the end of the original toner in the cartridge.

It is necessary to pay attention to this fact: the customer has the right to indicate that the delivered goods must have a certificate of conformity. At the same time, it is not allowed to establish in the auction documentation the requirement to provide a copy of the specified certificate as part of the bid of the bidder in accordance with the Law on the contract system, and an exhaustive list of information contained in the bid of the bidder is not provided.

In addition, according to Part 2 of Article 456 of the Civil Code of the Russian Federation, the seller is obliged to transfer to the buyer the accessories and documents related to the thing (technical passport, quality certificate, operating instructions, etc.) simultaneously with the transfer of the thing itself. The establishment of this requirement contains signs of an administrative offense, the responsibility for which is provided for by the Code of Administrative Offenses of the Russian Federation (hereinafter referred to as the Code of Administrative Offenses of the Russian Federation). The customer is also obliged to establish the place of supply of cartridges with specific addresses.

Thus, the main feature of placing an order for the supply of cartridges and other consumables for EWT is the indication of the trademark of the purchased goods without accompanying the words "or equivalent" by virtue of the Law on the contract system, since the supplied consumables are necessary to ensure their interaction with the electronic computer appliances and office equipment, i.e. goods used by the customer.

From July 1, 2016, when describing the object of procurement, customers are required to use the requirements of technical regulations adopted in accordance with the legislation on technical regulation and documents of the national standardization system. These requirements were established by Federal Law No. 104 of April 5, 2016.

Terms of reference for the supply of cartridges (purchase No. 000)

Mandatory requirements:

Due to the need to ensure the interaction of the purchased cartridges with the Customer's office equipment and the presence of cases of incompatibility of the equivalents of other manufacturers existing on the market, the use of which leads to the failure of the Customer's equipment, removal from the company's warranty service; since the cartridges will be used for printers and copiers under warranty service and the use of cartridges not recommended by the manufacturer may serve as a basis for refusing branded warranty service - only delivery is allowed original, recommended for use by the manufacturer of equipment (hereinafter referred to as original) consumables. Offer "equivalents", "compatible" cartridges and products from other manufacturers not allowed.

1. Cartridges must be original (from the manufacturer of office equipment), new (from 100% new components) not refilled, not remanufactured.

2. Cartridges must be manufactured in 2014 (on acceptance will be checked by batch number).

3. Plastic elements and metal parts of cartridges must not have cracks, swellings, scratches, dents and other defects that worsen their appearance and prevent normal operation of the cartridge. Pull tabs on cartridges, where provided) must not be damaged. Labels and stickers must be clear, clean and legible. Movable elements on the cartridges (shutters, dampers) should move easily without distortions and jamming.

4. Cartridges must be packed in a vacuum package, in an antistatic, sealed bag made of polymer material, while bags of cartridges with ultra-sensitive drums must be opaque. The cartridge packed in a package must be placed in an individual cardboard box, equipped, depending on the model, with inserts that exclude its movement inside the box. There should be no traces of ink or toner on the cartridge. The packaging of each cartridge must be printed or labeled with information containing the following data: - trademark and/or name of the manufacturer; - name of one or more models in which the cartridge can be used; - code of the original cartridge; - date of manufacture; The marking must be easy to read.

5. The production codes on the cartridges must match the production codes on the packaging.

6. The beginning of the warranty period is considered the day of signing by the Customer of waybills. The warranty documents must state the terms of the breach of warranty.

7. Delivery of purchased products is carried out by the Supplier (all delivery costs at the expense of the Supplier) to the Customer's warehouse (443013, 5).

8. Goods upon delivery must be accompanied by the following documents:

Warranty card;

Certificate of conformity of the GOST certification system of the State Standard of Russia for the supplied goods (if the goods are subject to mandatory certification);

Technical and operational documentation in Russian.

9. Delivery of goods is carried out in full.

The Customer, in the presence of the Supplier, has the right to select 10%, but not less than 1 piece. from a batch of goods of the same brand and model (hereinafter referred to as "Product Samples") to be sent to a certified service center of the manufacturer of the corresponding goods or to an independent examination selected by the Customer (hereinafter referred to as the "Service Center") to obtain a conclusion on originality, as well as for compliance with the following conditions : cartridges must be new (from 100% new components) not refilled, not remanufactured, supplied goods (hereinafter referred to as the “Conclusion of the service center”). An act is drawn up on sampling.

The consignments of goods from which samples were taken are accepted by the Customer for safekeeping until the receipt of the Conclusion of the service center. The conclusion of the service center is final and not subject to dispute.

If the Conclusion of the service center confirmed the delivery of goods that do not meet the requirements for originality, as well as compliance with the following conditions: cartridges must be new (from 100% new components) not refilled, not remanufactured, its results apply to the entire batch of goods.

At the same time, the Supplier must pay the cost of the examination no later than 2 (two) days from the date of receipt of the relevant requirement of the Customer.

The export of goods accepted by the Customer for safekeeping and its replacement with goods that meet the requirements of this agreement shall be carried out by the Supplier within 5 (five) days.

After delivery to the storage sites, the Customer, together with the Supplier's representative, checks the goods for damage after transportation, operability and the absence of manufacturing defects.

Export and disposal of individual packaging (boxes) from cartridges is carried out by the supplier's forces and means, within 1 day after the receipt of the application.

Warranty obligations:

1. The warranty period for supplied original cartridges must be at least 36 months from the date of delivery or within the resource limit.

2. If during the warranty period the product turns out to be counterfeit or does not comply with the terms of the Contract, which must be confirmed by an act of an independent examination or an act of an official service center of the manufacturer of office equipment, the Supplier is obliged at its own expense to replace the defective product with a new product of proper quality, which must be delivered within a period of not more than one day from the date of written notification.

3. The defective goods are returned to the Supplier at his expense after the delivery of the new goods.

4. In case of replacement of a defective product, the warranty period is extended by the amount of time spent on it.

5. In case of damage to the Customer's property due to design, manufacturing or other defects in the delivered goods, during the warranty period for the goods, the Supplier shall reimburse all losses incurred by the Customer.

6. The Supplier guarantees the conformity of the supplied products with the specifications during their use and storage and bears all costs for the replacement or repair of defective products identified by the Customer, if the defect does not depend on storage conditions or improper handling.

7. The supplier is obliged to deliver and unload the cartridges to the customer's warehouse in a manner that ensures their safety.

8. The Supplier delivers the products to the Customer's warehouse personally.

2.3. The Supplier undertakes to deliver the goods to the Customer and carry out loading and unloading operations on its own or with the involvement of third parties at its own expense.

3. Scope and terms of quality assurance:

3.1. The warranty period for maintaining functionality during storage of goods in accordance with the requirements of the manufacturer is 1 (one) year from the date of signing the Goods Acceptance and Transfer Certificate.

3.2. The Supplier provides warranty service for all delivered goods, including consultations of its own engineers or specialists, contractors involved by it on technical malfunctions and failures in the delivered goods, and, if necessary, replacement of the delivered goods during the warranty period specified in paragraph 3.1 of this Terms of Reference.

3.3. In the event of failure of the delivered goods (individual components and components) during the warranty period, provided that the Customer complies with the rules for its operation, the Supplier is obliged to replace the worn-out cartridges without additional payment within 24 hours from the date of receipt of a written request from the Customer with an appropriate reasoned requirement .

3.4. The supplier guarantees the quality and safety of the supplied goods in accordance with the current standards approved for this type of goods, and the availability of certificates that are mandatory for this type of goods (in accordance with clauses 4.4 of this Terms of Reference), drawn up in accordance with the current legislation of the Russian Federation and the terms of the contract, set out in terms of quality, technical characteristics, determined when placing a state order.

3.5. All supplied goods that have a limited shelf life and / or use, determined by the manufacturer, must have at least 12 months before the expiration of the specified period.

4. Requirements for the safety of goods:

4.1. The product must be made of environmentally friendly material, comply with the requirements of current legislation, state standards, technical specifications, technical regulations and other regulations governing the subject of this Terms of Reference, including compliance with sanitary rules and regulations.

4.2. The goods must have certificates or sanitary and hygienic conclusions and other documents confirming the quality of the goods, drawn up in accordance with the legislation of the Russian Federation.

4.3. The supplied goods must comply with the quality and safety requirements established by GOST, ISO, as well as other norms and rules for this type of goods (according to clauses 4.4 of this Terms of Reference).

4.4. The supplied goods must be environmentally friendly, safe for human health and comply with SanPin 2.2.2 / 2.4.1340-03 "Hygienic requirements for personal electronic computers and organization of work", GOST R 12.1.019-2009 "Occupational safety standards system. Electrical safety. General requirements and nomenclature of types of protection", GOST 12.1.007-76 "System of labor safety standards. Harmful substances. Classification and general safety requirements".

5. Requirements for the materials and equipment used:

5.1. The used equipment in the Department of the City of Moscow for Competition Policy is under the manufacturer's warranty, one of the warranty conditions for the operation of this equipment is the use of original consumables, including cartridges. Thus, the cartridges offered for delivery must be produced by the manufacturer of office equipment in their original packaging. Technical documentation indicating the requirements for the use of specific consumables, indicating trademarks and characteristics, is available on the official websites of equipment manufacturers: Hewlett-Packard - http://www.hp.com; Ricoh - http://www.ricoh.ru. According to the instruction manuals of the specified office equipment, to ensure optimal print quality and economy, use only genuine accessories designed for the specified series of office equipment. Delivery of compatible and remanufactured and/or refilled cartridges is not allowed.

5.2. The customer reserves the right to conduct an independent examination of cartridges for their originality. Identification as a result of the examination of non-original cartridges entails the return of the entire batch. Delivery of non-original products is not allowed. Cartridges must have protective seals (if these seals are provided by the manufacturer). The operation of cartridges should not lead to a violation of sanitary and hygienic standards when using it. Each supplied cartridge must comply with the quality, completeness and weight characteristics of filling, the specifications of the manufacturer of the printing devices for which the cartridge is purchased. After installing a new cartridge, the print should be clear from the first print sheet. When printing sheets, there should be no gray background. During operation, there should be no leakage of toner from the cartridge, increased sound noise associated with the operation of the cartridge. The density of the toner should be evenly distributed over the entire surface of the sheet. Cartridges must be guaranteed to be free from defects in materials and workmanship. Cartridges must be with a locking tape that can be removed by means of a check. The pin of the locking tape must be fixed on the side of the cartridge, be integral with the sidewall of the cartridge, have the same plastic consistency with the common cartridge body, and be able to break out of the side wall of the cartridge when the locking tape is removed.

5.3. The product must have a set of technical documentation and a user manual in Russian.

5.3.1. Requirements for the quality of packaging and sealing: Packaging must ensure the safety of transportation of the cartridge and the preservation of its quality during the period of storage and / or use. The product must be sealed in a way that excludes spontaneous spillage of toner, if it is provided for by its design. The sealing tape, if present, must be easily removed before putting the cartridge into service. When removing the ribbon, be careful not to spill toner from the ribbon exit. Deformation of the packaging of the supplied cartridges is unacceptable.

5.3.2. Marking requirements: The packing box must contain the following information: - type of cartridge and its compatibility with printers; - information about the manufacturer; - warranty period of storage until the cartridge is put into operation (if specified by the manufacturer); - manipulation signs in accordance with section 4 of GOST 14192-96 "Marking of goods"; - inside the packing box of each cartridge there should be an instruction containing the brand name of the cartridge manufacturer and all information about the product and the rules for its operation.

5.4. The cartridge body must be marked with the manufacturer's marking indicating the necessary identifying information. If there is a serial number, it must be indicated. Each cartridge must have its own production batch identification number, which is applied to the cartridge body. Serial numbers and manufacturer designations on the packaging and cartridge must match. The outer packaging and the inner polyethylene packaging must contain information about the cartridge manufacturer (cartridge manufacturer's trade name, cartridge manufacturer's registered trademark, or other information).

5.5. The supplier guarantees that the quality of the supplied goods meets the requirements specified in this Terms of Reference. The customer has the right to involve an independent organization to control the quality of the delivered goods. The product must not have any signs of mechanical damage, as well as other inconsistencies with the official technical description of the supplied product. The goods must be delivered and unloaded at the expense of the Supplier at the address of the Customer to the premises indicated by him by prior agreement.

5.6. The order of loading-unloading and transportation should exclude the possibility of mechanical damage to the delivered goods.

5.7. The total delivery time is from the moment of conclusion of the Contract to ______________. Delivery of goods is carried out in separate batches no later than 1 (one) business day from the date of receipt of the application by the Supplier, sent in the manner prescribed by clause 5.8 of this Terms of Reference.

5.8. Delivery of goods is carried out at the request of the Customer. The Customer sends an application to the e-mail address of the Supplier ______________, in which he indicates the assortment required for delivery, the quantity of goods and the delivery address. The Supplier confirms receipt of the application by sending a response to the Customer's e-mail address ___________________________. If the Customer does not receive confirmation from the Supplier within 1 (one) working day from the date of sending the application, such an application is considered received by default on the next business day after the day the application was sent by the Customer.
