Designers, construction expertise, State Fire Supervision - everyone is pulling in their direction, proceedings begin at the level of the Moscow government, but we have to decide according to the law.

Before starting “active actions”, it is necessary to consolidate opinions on a specific object between interested organizations: design organizations, experts, builders, construction supervision, operating organization that accepts the object.

Today, the regulatory framework has changed, but the regulatory and technical documentation remains the same. This is the main contradiction, and an objective contradiction.

We inherited an old regulatory framework, quite extensive, but at the same time not responsive to today’s new technologies. Therefore, emerging contradictions in norms cannot be discarded; we must strive for acceptable solutions.

The law on technical regulation is in force and must be implemented before and after the introduction of new technical regulations.

In the search for such solutions, one should be based on the new Town Planning Code, the law on Technical Regulation and the Decree of the Government of the Russian Federation of 01.01.01. No. 87 “On the composition of sections of design documentation and requirements for their content.”

We have the highest absolute death toll in the world, even compared to China, India, and even more so compared to America and Europe. All requirements must be met, but not every one can be fulfilled, because in some cases they work against a person and situations are created that contribute to the death of people.

In this regard, as part of the design documentation, the above-mentioned Decree of the Government of the Russian Federation dated January 1, 2001. No. 87 provides a special section “Measures to ensure fire safety”. This section should contain:

· justification of fire safety distances between buildings, structures and external installations, ensuring fire safety of capital construction projects;

· description and justification of design solutions for external fire water supply, for identifying passages and entrances for fire fighting equipment;

· description and justification of the adopted design and space-planning decisions, the degree of fire resistance and the class of structural fire hazard of building structures;

· description and justification of design solutions to ensure the safety of people in the event of a fire;

· list of measures to ensure the safety of fire departments during fire extinguishing;

· list of buildings, structures, premises and equipment subject to protection by automatic fire extinguishing installations and automatic fire alarm equipment;

· description and justification of fire protection (automatic fire extinguishing installations, fire alarms, warning and management of evacuation of people in case of fire, internal fire water supply, smoke protection);

· description and justification of the need for placement of fire protection equipment, control of such equipment, interaction of such equipment with engineering systems of buildings and equipment, the operation of which during a fire is aimed at ensuring the safe evacuation of people, extinguishing the fire and limiting its development, as well as the algorithm for the operation of technical systems ( means) of fire protection (if available);

· description of organizational and technical measures to ensure fire safety of a capital construction project;

· calculation of fire risks of threat to the life and health of people and destruction of property (if the mandatory fire safety requirements established by technical regulations are met and the requirements of regulatory documents on fire safety are met on a voluntary basis, fire risk calculation is not required).

The graphic part of the section should include:

· situational plan for the organization of a land plot provided for the placement of a capital construction project, indicating the entry (exit) to the territory and access routes to the fire equipment facilities, locations and capacities of fire tanks (if any), laying diagrams for the external fire-fighting water supply system, placement locations fire hydrants and pumping station locations;

· schemes for evacuation of people and material from buildings (structures) and from the territory adjacent to buildings (structures) in the event of a fire;

· block diagrams of technical systems (means) of fire protection (automatic fire extinguishing installations, automatic fire alarms, internal fire-fighting water supply).

If the requirements for reliability and safety established by regulatory technical documents are not sufficient for the development of design documentation, the development of special technical conditions (STU) for the design of fire safety measures is required.

The procedure for developing and approving STUs is sufficiently fully covered in Order No. 36 of 01/01/2001. Ministry of Regional Development and his letter dated January 1, 2001. No. 000 – SK/08.

The specified special technical conditions must reflect the specifics of fire protection of a capital construction project, including a set of additional engineering, technical and organizational measures. It is permitted to include provisions containing deviations from current standards into special technical specifications, provided that the need for such deviations is justified and that regulations compensating for these deviations are developed as part of the special technical specifications.

Similarly, additional fire safety requirements must be justified in comparison with the requirements established in the current regulatory technical documents.

Additionally, it is reported that special technical conditions containing technical requirements for the design and construction of facilities in terms of ensuring fire safety are submitted to the Ministry of Regional Development of Russia by the construction customer in the presence of a positive conclusion from the Ministry of Emergency Situations of Russia. Information on the approval of special technical conditions by the relevant authorities of the state fire supervision of the Ministry of Emergency Situations of Russia is indicated in the explanatory note with a copy of the letter from the Ministry of Emergency Situations of Russia attached.

Question: What is the procedure for developing and documenting fire safety measures?

Answer: Part 12 of Article 48 of architectural and construction design of the Town Planning Code for the first time regulates the mandatory presence of this section. Only some delivery facilities fall under the jurisdiction of the Decree of the Government of the Russian Federation dated 01.01.01. No. 87 “On the composition of sections of design documentation and requirements for their content.”

Not all organizations have specialists with technical or higher fire education. There has been a rotation of specialists, it is necessary to attract specialized organizations. The composition of the section is determined by the above resolution. The requirements for its design are the same as for all project documentation.

Question: What is fire safety?

Answer: Fire safety is not engineering systems, but a security system created by various engineering systems to save the lives of people and objects.

Question: What is the established procedure for accepting a project for examination?

Answer: The procedure for passing the project examination is described in the new Town Planning Code. The project is not accepted for examination without the “Fire Safety Measures” section.

A few points about fire safety design licenses:

There are 2 types of licenses, this issue is not resolved in the best way:

1 - Licenses issued by the Federal Licensing Center.

2 - Licenses issued by the Russian Ministry of Emergency Situations.

The list of works of the first type of licenses indicates engineering systems to ensure fire safety, but there is no mention of the section “List of measures to ensure fire safety.” There is no extended document interpreting the list of fire safety measures.

Thus, in these types of licenses there is no section “Measures to ensure fire safety,” which is mandatory as part of project documentation, according to the new Urban Planning Code.

Question: How is the safety of firefighters ensured?

Answer: The most difficult question that a designer solves is how to ensure the safety of firefighters. Service comes with risk. There are firefighter safety techniques that are subject to adjustment and are practically taught.

Question: Who approves the STU - the Ministry of Emergency Situations or the Ministry of Regional Development?

Answer: The procedure for developing and approving the STU is quite fully covered in Order No. 36 dated April 1, 2008 of the Ministry of Regional Development and its letters dated April 08. Specifications are developed after designing the main parameters of the object. The final specifications and calculations are made by the time the project is submitted for examination.

The most typical deviations from the section design rules:

There is no answer to the questions: a) ensuring the safety of people, b) ensuring the preservation of property.

Examples:

Question: What should the list of measures to ensure the safety of firefighters include?

Answer: As an example: separate entrances to the basement and flights of stairs reaching the roof (SNiP 210197).

Question: I would like to see methodological recommendations for the development of the section “Measures to ensure fire safety.”

Answer: Rosexpertiza does not have the right to issue such recommendations, but the organizers of this seminar, the Ministry of Regional Development, can.

Question: Procedure for determining the cost of design work?

Answer: Currently, there is a sufficient regulatory framework on pricing issues in construction, including in the design complex. There are reference books of basic prices at the “federal level” and regional prices. In the absence of pricing standards, the price of the project is determined according to the well-known methodology for the labor costs of designers.

List of documents required for the state examination of the results of engineering surveys and design documentation.

Submission of documents for state examination

1. To conduct a state examination, both design documentation and the results of engineering surveys carried out for the preparation of such design documentation are submitted:

a) an application for a state examination, which indicates:
identification information about the performers of the work - the persons who prepared the design documentation and carried out the engineering surveys (last name, first name, patronymic, details of identity documents, postal address of the individual entrepreneur’s place of residence, full name, location of the legal entity);

b) identification information about the capital construction project, design documentation and (or) the results of engineering surveys in respect of which are submitted for state examination (name of the proposed construction object (objects) (reconstruction, major repairs), postal (construction) address of the capital object (objects) construction, main technical and economic indicators of the capital construction object (objects) (area, volume, length, number of floors, production capacity, etc.));dated March 31, 2012 N 270 );

c) identification information about the applicant (last name, first name, patronymic, details of identity documents, postal address of the place of residence of the developer (technical customer) - an individual, full name of the legal entity, location of the developer - legal entity, and if the developer (technical customer) and the applicant are not the same person - the specified information also applies to the applicant);(as amended by the Decree of the Government of the Russian Federation dated March 31, 2012 N 270 ) Subparagraphs b) - c) - Eliminated. d) design documentation for a capital construction project in accordance with the requirements (including the composition and content of sections of documentation) established by the legislation of the Russian Federation;

e) a copy of the design assignment;

E) the results of engineering surveys in accordance with the requirements (including the composition of these results) established by the legislation of the Russian Federation;

g) a copy of the assignment for performing engineering surveys;

h) a positive conclusion of the state environmental examination in the event that project documentation developed in relation to capital construction projects, the construction or reconstruction of which is supposed to be carried out in the exclusive economic zone of the Russian Federation, on the continental shelf of the Russian Federation, in internal sea waters, is submitted for the state examination in the territorial sea of ​​the Russian Federation, as well as design documentation developed in relation to facilities related to the disposal and disposal of waste of hazard classes I - V, artificial land plots on water bodies (except for cases when the applicant for state examination submits design documentation developed in in relation to the objects specified insubclause 7(1) Article 11 andsubsection 4(1) Article 12 of the Federal Law "On Environmental Expertise");

i) documents confirming the applicant’s authority to act on behalf of the developer, technical customer (if the applicant is not a technical customer and (or) developer), in which the authority to conclude, amend, execute, terminate the agreement to conduct a state examination (hereinafter - contract) must be specifically agreed upon.

j) a certified copy of a certificate issued by a self-regulatory organization on the admission of the work contractor to the relevant type of work for the preparation of design documentation and (or) engineering surveys, valid on the date of signing the acceptance certificate for the work performed, and a copy of the acceptance certificate for the work performed if, in accordance with the law In the Russian Federation, obtaining permission to perform such work is mandatory.

2. To conduct a state examination of the results of engineering surveys, before sending design documentation for state examination, the documents specified in subparagraphs “a” - “c” and “e” - “i” of paragraph 13 of these Regulations, as well as a certified copy of the certificate issued by a self-regulatory organization are submitted on the admission of the work performer to the relevant type of engineering survey work, valid on the date of signing the acceptance certificate for the work performed, and a copy of the acceptance certificate for the work performed if, in accordance with the legislation of the Russian Federation, obtaining admission to such work is mandatory.

3. To conduct a state examination of the results of engineering surveys in the cases specified in paragraph 8 of these Regulations, the documents specified in subparagraphs “a” and “e” - “i” of paragraph 13 of these Regulations are submitted, as well as:

a) design documentation for external engineering networks and design solutions for foundations;

b) a positive conclusion of the state examination in relation to the applied standard design documentation (modified standard design documentation), issued to any person;

c) a document confirming the right of the developer (technical customer) to use standard design documentation, the exclusive right to which belongs to another person (agreement on the alienation of the exclusive right, license agreement, sublicense agreement, etc.).

d) a document confirming the compliance of climatic and other conditions in which the standard design documentation is planned for re-use with the conditions under which it was developed for initial use. The form of this document is approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation.)

e) if, when using standard design documentation, the preparation of design documentation for external utility networks and structural solutions for foundations is required, - certified copies of a certificate of admission of the work performer to the relevant type of engineering survey work issued by a self-regulatory organization and (or) a certificate of admission of the work performer to the corresponding type of work on the preparation of project documentation in cases where, in accordance with the legislation of the Russian Federation, obtaining permission to such work is mandatory.

The specified certificates must be valid on the date of signing the acceptance certificate for the work performed. Along with copies of such certificates, a copy of the acceptance certificate for the work performed is submitted.

4. To conduct a state examination of design documentation, after a state examination of the results of engineering surveys carried out to prepare such design documentation, the documents specified in paragraph 13 of these Regulations are submitted (with the exception of a copy of the assignment for performing engineering surveys, as well as a certified copy of the certificate issued by a self-regulatory organization on the admission of the work contractor to the corresponding type of engineering survey work), and a positive conclusion of the state examination of the results of engineering surveys, while the results of engineering surveys are not re-submitted.

5. The organization for conducting state examination has the right to additionally request from the applicant to provide calculations of design and technological solutions used in the design documentation, as well as engineering survey materials. The specified calculations and materials must be submitted by the applicant within 5 days after receiving the relevant request. Requesting other information and documents from applicants is not allowed.

6. The documents specified in paragraphs 13 - 16 of these Regulations are submitted on paper or in the form of electronic documents using, inter alia, the federal state information system "Unified portal of state and municipal services (functions)" (if appropriate technical capabilities are available). Electronic documents submitted by the applicant must be signed with an enhanced qualified electronic signature. If documents are presented on paper, the agreement on conducting state examination may stipulate that design documentation and engineering survey results can also be presented in electronic form.

7. Design documentation for a capital construction project may be presented in relation to individual stages of construction and reconstruction of a capital construction project.

Initial data and conditions for the preparation of design documentation for a capital construction project.

Design assignment - in case of preparation of design documentation on the basis of a contract;

Reporting documentation based on the results of engineering surveys;

Title documents for a capital construction project - in the case of preparation of design documentation for reconstruction or major repairs of a capital construction project;

Approved and registered in accordance with the established procedure urban planning plan of the land plot provided for the placement of a capital construction projector in the case of preparing design documentation for a linear facility, a territory planning project and a territory surveying project(clause supplemented on March 25, 2011 by Federal Law of March 20, 2011 N 41-FZ);

Documents on the use of land plots to which urban planning regulations do not apply or for which urban planning regulations are not established, issued in accordance with federal laws by authorized federal executive authorities, or authorized executive authorities of constituent entities of the Russian Federation, or authorized local government bodies;

Technical conditions providedpart 7 of article 48 Town Planning Code of the Russian Federation and other regulatory legal acts, if the operation of the designed capital construction facility is impossible without its connection to public utility networks (hereinafter referred to as technical conditions);

Documents on approval of deviations from the provisions of technical specifications;

Permission to deviate from the maximum parameters of the permitted construction of capital construction projects;

Acts (decisions) of the owner of the building (structure) on the decommissioning and liquidation of a capital construction project - if demolition (dismantling) is necessary;

Other initial permitting documents established by legislative and other regulatory legal acts of the Russian Federation, including technical and urban planning regulations;

The decision of the local government body to recognize a residential building as unsafe and subject to demolition - if it is necessary to demolish the residential building;

The transition from paper document management to electronic one has been underway for a long time; changes are taking place both at the enterprise level and at the state level. In particular, for organizations that produce design documentation and the results of engineering surveys of objects, from September 1, 2016, the process of accepting documentation of objects to Glavgosexpertiza, the capital construction or reconstruction of which is carried out partially or fully at the expense of the federal budget, is changing. Now it is submitted for examination in electronic form and that’s the only way. From January 1, 2017, this approach will extend to the submission of all new projects to regional expert organizations in accordance with the Decree of the Government of the Russian Federation of December 7, 2015 N 1330 “On amendments to the Decree of the Government of the Russian Federation of March 5, 2007 N 145”.

Problems and difficulties

In connection with the transition to the examination of project documentation in electronic form, difficulties arise for both applicants and experts.

There are economic, technical and organizational difficulties in the project of transition of organizations to providing examination services in electronic form, and less than two months are left to complete the assigned tasks.

The project is checked by experts for compliance with government regulations, rules and standards, as well as technical requirements for project documentation. If there is a negative conclusion from the state examination, such documentation cannot be approved by the developer or customer. This means that additional time and material costs will be required to deliver the entire set in order to make corrections to the technical documentation, and possibly to prepare a new package of technical documentation. Technical documentation developed and transferred to the contractor for construction work must include a specific list of documents approved by regulations.

The absence of the required list of documents, non-compliance with the structure and technical requirements for project documentation is grounds for refusal to accept a project submitted for state examination in both paper and electronic form.

For a long time, documentation was submitted for examination on paper, which led to large time and financial losses when the project was returned for revision. Over the past few years, only a few regional expert organizations have gradually changed the regulations for conducting examinations, including starting to accept not only paper originals, but also files with drawings and explanatory notes as supporting material, in order to reduce the time of verification and drawing up a conclusion.

Now a new era is dawning - working with electronic documents, namely with electronic originals, which should replace paper originals.

Let's look at some scenarios for the state examination of project documentation in electronic form, namely scenarios for working with established formats of electronic documents provided to the state examination bodies in accordance with Order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr. This order also formulates technical requirements for project documentation, which determine the procedure for preparing text and graphic materials in electronic form that are part of the project documentation.

Let's look at scenarios for working with some familiar formats, for example, doc and dwg. Such files are subject to random distortion and are also highly dependent on user settings (fonts, line styles), and versions of the software product in which they were created. If the designer submits such a file for examination, then there is a high probability of distortion of the information received during viewing. And even if you protect the file with an electronic signature, the possibility of information distortion remains, while the signature certificate itself remains valid. Let us remind you that a document signed with a qualified electronic signature is considered legally significant and is equivalent to a paper document with a handwritten signature. And participants in the process bear legal responsibility when working with electronic documents.

Let's move on to pdf documents. It would seem that it is able to protect the file from changes, since it is a fixed markup format. But when working with it, other difficulties arise. Project documentation contains a large number of graphics-intensive drawings, so when they are viewed and transferred between experts, there is a heavy load on computers and local networks, and it takes a lot of time to process them.

Using the XPS format

We suggest considering the use of the open XPS format. This format is built into Windows operating systems, so it does not require any additional programs to use it. Tools for working with XPS for other operating systems (Mac OS, Linux, iOS, Android) are freely available. The XPS format allows you to correctly reproduce characters from all fonts used in a document, even if these fonts are not on the user's computer. And to convert an edited file into an XPS document, just print it on the Microsoft XPS Document Writer virtual printer, built into Windows operating systems starting with Windows XP SP3. Thus, we receive an electronic document that is protected from changes and distortions when viewing it, which looks exactly as it was created by its author, regardless of the program in which it was developed. The XPS format allows you to use an enhanced electronic signature in accordance with SPDS standards (indicating the role of the signatory) without installing additional software, after which the document becomes an electronic original.

The XPS format is open and based on XML, which allows software developers for organizing work with electronic documents to add additional functions: annotating documents, automatic content analysis, automatic comparison of versions, etc.

To conduct inter-organizational electronic document flow, for example, in a designer-customer, designer-contractor relationship, or for interaction with expert organizations, projects are exported/imported in the system. 1. 1. Document formats.

1.1. Summary estimate:

- Recommended document format: *.xlsx.

- Acceptable document formats: *.pdf (with the obligatory ability to copy text), *.xml (PC "GRAND-Smeta").

- The material must be duplicated with signatures and seals in *.pdf format.

1.4. Documents justifying the price of materials not included in the price lists of the base period (price lists):

- Recommended document format: *.pdf with signatures of the developers and the customer.

1.5. Contents of documents:

- One book of documentation - one document; it is not allowed to create documentation on the principle of “one page - one document”.

- Text fragments must be included in the document as copyable text.











2. Requirements for scanning parameters:

2.1. Scanning must be done directly from the original document at a scale of 1:1 (scanning from photocopies is not allowed).

2.2. If there are no graphic images in the document, it is recommended to scan in black and white, provided that the text in the document is black.

2.3. If your document contains color graphics or color text, you must scan the document in full color mode.

2.4. If your document contains images other than color, it is recommended that you scan in Grayscale mode, provided that the text in the document is black.

2.6. Documents of the graphic part of the design documentation must be scanned with a resolution of 300 dpi for formats A4, A3, A2 (including multiple formats) and 300 dpi for formats A1 (including multiple formats) and A0.

2.7. The composition, content and form of the generated electronic sets of design documentation must be such that when they are printed, the paper copy of the document is fully consistent with its original (including in scale and color), without any additional actions on the part of the user.

3. Authentic electronic documents.

3.1. A set of authentic ED is a set of design and documentation documents prepared on the basis of a computer original (without reproduction on paper) in graphic and text editors.

3.2. Certification of design documentation in the mode of an authentic document (without reproduction on paper) can be carried out in one of two ways listed below:



GOST 2.051-2006 Electronic documents.

3.3. The UL, fully prepared on paper, is scanned and saved in *.pdf formats, signed by the electronic signature of the authorized person of the applicant organization, after which it is collected into one book (document) and can be submitted for examination.

7. Composition and contents of folders.

7.1. The composition and contents of the folder-catalog "Explanatory Note" to the estimate documentation, summary estimate calculation, object and local estimate calculations must be carried out in accordance with the Regulations on the composition of sections of project documentation and requirements for their content, approved by the Methodology for determining the cost of construction products on the territory Russian Federation MDS 81-35.2004.

7.2. Composition and contents of the catalog folder "Bill of quantities and specifications":

- Statements of quantities of construction and installation work, specifications for equipment and furniture must be presented for each section of the design documentation and types of engineering surveys separately.

- Statements of quantities of construction and installation works, specifications for equipment and furniture must be duplicated in the form of scanned images of documents with signatures of the developers and the Chief Executive Officer, presented in *.pdf format.

- All items in the bills of quantities must contain references to drawings and formulas for calculating the volume of work.

7.3. Composition and contents of the directory folder "Price Lists":

- Price lists must be selected on the basis of a market analysis of the most economical solution (in accordance with MDS 81-35.2004), with a comparative table of cost indicators, confirmed by the Customer and presented in *.pdf format.

- The price in the price lists must include a breakdown of the costs included in the price (VAT, packaging, transportation costs, equipment, etc.) in ruble terms.

7.4. Composition and contents of the directory folder "IRD"


- conclusion of the state examination;

- design assignment;



- Decision on the preparation and implementation of budget investments in a capital construction project;

- comparative statements (for re-examination);



- Other data.

Scanned images of documents with signatures and seals (where necessary) must be presented in *.pdf format and fully correspond to the original.

8. Repeated verification of the accuracy of the estimate documentation.



- the explanatory note includes a comparative statement of changes in the estimated cost included in the estimate documentation based on the negative conclusion of the state examination;

- in case of correction of previously approved project documentation, comparative statements of changes in the estimated cost and scope of work are included in the explanatory note.

9. Conducting a verification of the accuracy of the estimate documentation after receiving a positive conclusion from the state examination of the design documentation and/or the results of engineering surveys.

The procedure for providing documentation is the same as described above, with the exception of:

- all design documentation and/or engineering survey results approved during the examination are provided for the inspection.

4. Authentic electronic documents.

4.1. A set of authentic ED is a set of design and documentation documents prepared on the basis of a computer original (without reproduction on paper) in graphic and text editors.

4.2. Certification of design documentation in the mode of an authentic document (without reproduction on paper) can be carried out in one of two ways listed below:

- each person participating in the development, carrying out normative control and approval of design documentation certifies the ED with his ES. The certification procedure is determined by the internal regulations of the applicant organization. A fully prepared ED is signed by an ED of an authorized person of the applicant’s organization, after which it can be submitted for examination;

- if it is impossible to provide all responsible persons with an electronic signature for individual documents, books, sections (volumes) of the project, an information and identification sheet (ID) is drawn up. The UL indicates the designations of the ED to which it was issued, the names and original signatures of the persons who developed, checked, agreed upon and approved the corresponding ED. The signatures of the persons who developed the ED and UL, and the normative inspector are required. The corresponding “Date” column of the UL indicates the date and time of the last change to the approved document. Recommendations for registration of UL are contained in GOST 2.051-2006 Electronic documents.

4.3. The UL, fully prepared on paper, is scanned and saved in *.pdf formats, signed by the electronic signature of the authorized person of the applicant organization, after which it is collected into one book (document) and can be submitted for examination.

6. General rules for naming documents of electronic documents.

The name of the document must be clear, correspond to the name on the title page and the composition of the project.

7. The directory structure of the submitted documentation should be as follows:

Directory folder with the name:

- Folder directory "Project documentation";

- Folder-catalog "Results of engineering surveys";

- Folder directory "IRD (initial permitting documentation)";

- Other folders (if necessary).

8. The composition and contents of the “Project Documentation” directory folder must correspond to the composition of the sections of the project documentation (PD).

- The composition of sections of the PD must be carried out in accordance with the Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation dated February 16, 2008 N 87.

- Each PD section is contained in a separate folder (directory). The names of the folders correspond to the names of the sections (eg; Section 1. Explanatory note). It is allowed to abbreviate the names of sections while maintaining the meaning of their content.

- Drawings, title pages of notes must be duplicated in the form of scanned images of documents, with signatures of the developers and presented in *.pdf format.

9. The composition and contents of the catalog folder “Results of engineering surveys” must correspond to the types of work on engineering surveys (IS) in accordance with the “List of types of work...” approved by order of the Ministry of Regional Development of Russia dated December 30, 2009 N 624.

- Types of work on AI must comply with the requirements: Article 47 of the Town Planning Code of the Russian Federation, clause 4.22 SNiP 11-02-96 "Engineering surveys for construction. Basic provisions".

- Each type of work on AI is contained in a separate folder (directory). The names of the folders correspond to the types of engineering survey work: engineering-geodetic (ITGI), engineering-geological and engineering-geotechnical (IGI), engineering-hydrometeorological (IGMI), engineering-ecological (EI) surveys, as well as: inspection of the condition of soils of the foundations of buildings and structures (CSO), inspection of building structures of buildings and structures (OSC).

- Each engineering survey folder contains documents (folders): text report, text applications, graphic applications.

- Drawings, title pages of notes, technical specifications, certificates of permission to work must be duplicated in the form of scanned images of documents, with the signatures of the developers and presented in *.pdf format.

10. Composition and contents of the directory folder “Initial permitting documentation”.

Separately, in folders with the appropriate name, other materials necessary for conducting the state examination are located:

- conclusion of the state environmental assessment (positive);

- design assignment;

- assignment to perform engineering surveys;

- SRO of design organizations and organizations performing engineering surveys;

- special technical conditions;

- certificate and register (for re-examination);

- documents confirming the applicant’s authority;

- a copy of the work acceptance certificate;

- other data.

All documents must be submitted in *.pdf format, have signatures and seals where necessary and fully correspond to the originals.

11. Re-examination of design documentation.

During the re-examination, the procedure for providing PD and engineering survey results corresponds to the above, with the exception of:

- the explanatory note includes a certificate and a register of changes made to the design and estimate documentation and the results of engineering surveys based on the negative conclusion of the FAA "Glavgosexpertiza of Russia".

Based on paragraph 18 of Regulation No. 145, documents provided for in paragraphs 13-16 of Regulation No. 145 and submitted in electronic form are signed by the head of the organization or his authorized person using UKEP. In this case, the persons who have the right to sign the specified documents using the UKEP are the persons who have the authority to sign the relevant documents prepared in the form of documents on paper.

As for the initial permitting documents submitted as part of the “Explanatory Note” section as part of the project documentation itself, based on paragraph 11 of the Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation dated February 16, 2008.
No. 87, copies of these documents, drawn up in the prescribed manner, may be submitted for state examination. In this case, the requirements provided for in paragraphs 6, 8, 9 of the Requirements are imposed on the execution (including certification) of such copies. In particular, on the basis of paragraph 8 of the Requirements, electronic documents (including their copies), which, according to established requirements, are an integral part of the project documentation, are certified by the electronic signature of the person(s) participating in the development of the project documentation, carrying out standard control and approval of project documentation, and electronic signature of the applicant.

In accordance with clauses 22 and 23.1 of Regulation No. 145, based on the results of checking the completeness of the documents submitted for the state examination, the applicant must be presented (sent) one of the following documents:

— a draft agreement calculating the amount of fees for conducting the state examination, signed by the organization for conducting the state examination;

— reasoned refusal to accept submitted documents;

— notification of the decision made to leave the submitted documents without consideration, indicating the reasons for its adoption.

Each of the above documents, in accordance with the general rules of business correspondence, must be sent by an appropriate letter signed by an authorized person of the central office of the FAU "Glavgosexpertiza of Russia" or its branch.

According to subparagraphs “j” and “l” of paragraph 2 of Decree of the Government of the Russian Federation of March 5, 2007 No. 145, documents required for conducting state examination, starting from the dates specified in these subparagraphs, are submitted in electronic form (except for cases when project documentation and (or) the results of engineering surveys contain information, access to which is limited in accordance with the legislation of the Russian Federation).

Clause 18 of Regulation No. 145 establishes that the requirements for the format of documents submitted in electronic form are approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation.

The presence of deficiencies in documents submitted in electronic form in terms of non-compliance with established requirements (including Requirements) may serve as the basis for a decision to leave documents without consideration (subparagraph “b” of paragraph 23 of Regulation No. 145).

An employee of the contract department places a contract with a number and date in the electronic system (the exceptions are the same as when preparing only a paper version).

It is then signed by the deputy chief in the electronic system. If the agreement on conducting a state examination, at the request of the applicant, must be prepared in the form of a document on paper, an agreement with a number and date on paper is simultaneously prepared and, after signing, is handed over to the applicant. In this case, the agreement on paper is considered legally significant.

More detailed advice on the issues of concluding contracts can be obtained from specialists of the Department of Planning and Contractual Work of the Project Support Directorate of the central office of the State Autonomous Institution VO “Center of State Expertise for the Voronezh Region”.

According to paragraph 12 of the Requirements, each section of the design documentation must be contained in a separate folder (directory), the names of these folders must correspond to the names of the sections.

To carry out the examination, all sections of the design documentation must be submitted, which, in accordance with Part 12 of Article 48 of the Town Planning Code and the Regulations approved by Decree of the Government of the Russian Federation of February 16, 2008 No. 87, are mandatory.

It should be noted that in connection with the technological features of the interactive interaction system of the State Autonomous Institution of Higher Education “Center of State Expertise for the Voronezh Region”, the directory folders provided in the structure of the project documentation in the applicant’s Personal Account must necessarily contain a file with an electronic document. If, in accordance with the law, the development of a section of project documentation is not required, the applicant is recommended to place a file with an electronic document of any form in the format established by the Requirements in the directory folder of the corresponding section in the format established by the Requirements, containing information about the absence of the need to develop a section with appropriate justification.

It is recommended to place the “Composition of Project Documentation” sheet, drawn up as a separate volume, in the “Other Documentation” directory folder as part of the “Project Documentation” directory folder.

According to GOST 21.1101-2013 “System of design documentation for construction. Basic requirements for design and working documentation”, in the volume of design documentation in which the corresponding changes have been made, a table for recording changes is placed.

In order to promptly review the project documentation by the Institution’s specialists and reduce the time for preparing the state examination report, it is recommended that a copy of the permission to make changes is also placed in the appropriate volume of the project documentation.

No. 108, the execution and design of text and graphic materials included in the design documentation (including changes to them) must be carried out in accordance with the requirements of the national standard GOST 21.1101-2013 “System of design documentation for construction. Basic requirements for design and working documentation." In particular, the rules for making changes to design documentation are established by section 7 of this standard.

According to paragraph 9 of the Requirements, the IUL must indicate the date and time of the last change of the relevant DE. Thus, after making a change, the IUL must be scanned again and certified with the electronic signature of the person authorized to submit documents for state examination.

According to paragraph 4 of the Requirements, text fragments within an electronic document must be copyable.

According to paragraph 5 of the Requirements, the structure of a DE should include the content and search for this DE, as well as bookmarks on the table of contents and the list of tables and figures contained in the DE.

According to paragraph 12 of the Requirements, each section of the design documentation must be contained in a separate folder (directory), and the names of these folders must correspond to the names of the sections.

Based on paragraphs 3 and 4 of the Requirements, the pdf format is presented with the obligatory ability to copy text; text fragments as part of a DE presented in a different format must be able to be copied. The possibility of copying text that is part of a graphic image contained in the DE is not stipulated by the Requirements.

According to paragraph 5 of the Requirements, the structure of an electronic document must include the content and search of this document, as well as bookmarks on the table of contents and the list of tables and figures contained in the document.

In accordance with paragraph 9 of the Requirements, the IUL is issued in relation to each individual document, section (volume, book) of project documentation, submitted in the form of an electronic document (i.e., a separate file).

According to paragraph 9 of the Requirements, the IUL must contain the names and signatures of all persons involved in the development, verification, coordination and approval of the relevant DE.

According to paragraph 10 of the Requirements, approved by order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr (hereinafter referred to as the Requirements), the name of the electronic document must correspond to the name of the document on paper.

Order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr “On approval of requirements for the format of electronic documents submitted for state examination of design documentation and (or) engineering survey results” does not establish requirements for the preparation of IUL.

At the same time, according to the order of the Ministry of Regional Development of Russia dated April 2, 2009 No. 108 “On approval of the rules for the execution and execution of text and graphic materials included in the design and working documentation”, the execution and execution of text and graphic materials included in the design documentation, must be carried out in accordance with the national standards “System of design documentation for construction”, which are approved by orders in the prescribed manner.

Currently, the Russian Federation has a national standard GOST 21.1101-2013 “System of design documentation for construction. Basic requirements for design and working documentation." According to Appendix D to the specified standard, accounting when performing graphic and text documentation for construction is also subject to GOST 2.051-2006 “Unified system of design documentation. Electronic documents. General provisions."

Appendix B to GOST 2.051-2006 defines the recommended rules for the implementation and form of IUL.

According to paragraph 11 of the Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 No. 87, as part of the project documentation it is allowed to submit not only original documents, but also their copies, drawn up in the prescribed manner.

In order to submit electronic initial permitting documents, the originals of these documents on paper must be scanned. If such scanned copies are certified by the UKEP of the applicant (and not the person who issued the relevant document), then they can be considered by the Institution as copies of documents.

Please note that according to the legislation on urban planning activities, the developer (technical customer) is obliged to provide the designer with originals (and not copies) of the original permitting documents.

Conducting a state examination of design documentation and engineering survey results submitted to the FAU “Glavgosexpertiza of Russia” in electronic form, including the exchange with the applicant of information and documents submitted in connection with the state examination of these materials, is carried out through the applicant’s Personal Account in the system interactive interaction of the FAU "Glavgosexpertiza of Russia", which does not involve the exchange of documents on paper.

At the same time, by agreement with the applicant, the preparation of an agreement on conducting a state examination can be carried out in the form of a paper document.

According to paragraph 18 of Regulation No. 145, documents submitted in electronic form are signed by the head of the organization or his authorized person using an enhanced qualified electronic signature provided for by the Federal Law “On Electronic Signatures”.

According to paragraph 2 of Article 160 of the Civil Code of the Russian Federation (hereinafter - the Civil Code of the Russian Federation), the use of an electronic signature when making transactions (including unilateral ones - by virtue of Article 156 of the Civil Code of the Russian Federation, according to which general provisions on contracts apply to them) is allowed in cases and in the manner provided for by law, other legal acts or agreement of the parties.

Part 1 of Article 6 of the Federal Law of April 6, 2011 No. 63-FZ “On Electronic Signature” stipulates that information in electronic form signed with a qualified electronic signature is recognized as an electronic document equivalent to a paper document signed with a handwritten signature, and can apply in any legal relationship in accordance with the legislation of the Russian Federation (except for the case where federal laws or regulations adopted in accordance with them establish a requirement for the need to draw up a document exclusively on paper).

Thus, the head of the organization that issued the corresponding document, or a person authorized by the head of such an organization, has the right to sign documents submitted in electronic form.

At the same time, it is reported that, in accordance with paragraph 4 of Article 185.1 of the Civil Code of the Russian Federation, a power of attorney on behalf of a legal entity is issued signed by its director or another person authorized to do so in accordance with the law and constituent documents.

Based on the order of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated April 7, 2015 No. 249/pr “On approval of the Departmental List of State Services” (works) provided (performed) under the jurisdiction of the Ministry of Construction and Housing and Communal Services of the Russian Federation federal government agencies as the main types of activities” state examination of design documentation and state examination of engineering survey results are public services.

The rules for determining the types of electronic signatures, the use of which is allowed when applying for state and municipal services, approved by Decree of the Government of the Russian Federation of June 25, 2012 No. 634, a power of attorney confirming the authority to apply for state or municipal services, issued by an organization, is certified by a strengthened qualified electronic signature of an authorized official of the organization.

Clause 39 of the Regulations on the organization and conduct of state examination of design documentation and engineering survey results, approved by Decree of the Government of the Russian Federation of March 5, 2007 No. 145 (hereinafter referred to as Regulation No. 145), establishes that when the applicant submits documents in electronic form for the state examination of project documentation, the issuance of a state examination conclusion is also carried out in electronic form.

Based on the Requirements for the composition, content and procedure for drawing up the conclusion of the state examination of design documentation and (or) the results of engineering surveys, approved by Order of the Ministry of Construction of Russia dated December 9, 2015 No. 887/pr, information about all documents submitted must be reflected in the conclusion of the state examination for carrying out state examination. The information reflected in the conclusion of the state examination may contain information about the content of relevant documents, which may include information of limited access.

Taking into account the above and based on the principle established by paragraph 3 of Regulation No. 145 of ensuring measures for the non-disclosure of confidential information that became known to the FAU "Glavgosexpertiza of Russia" in connection with the state examination, the Institution does not have the right to accept project documentation and (or) results for state examination engineering surveys in electronic form if the documents required for such state examination contain restricted information.

In accordance with paragraph 18 of the Regulations on the organization and conduct of state examination of design documentation and engineering survey results, approved by Decree of the Government of the Russian Federation of March 5, 2007 No. 145, electronic submission of design (including estimate) documentation is carried out using including the federal state information system “Unified portal of state and municipal services (functions)”. Before the deadlines stipulated by subparagraphs “k” and “l” of paragraph 2 of this resolution, the agreements on conducting state examination concluded at the State Autonomous Institution VO “Center for State Expertise in the Voronezh Region” stipulate that if the documents are submitted by the applicant on paper , project documentation is also submitted in electronic form.

Requirements for the format of electronic documents submitted for state examination of design documentation were approved by order of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated November 21, 2014 No. 728/pr.

According to paragraph 18 of the Regulations on the procedure for organizing and conducting state examination of design documentation and engineering survey results, approved by Decree of the Government of the Russian Federation dated March 5, 2007 No. 145, requirements for the format of documents submitted in electronic form are approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation .

Subparagraphs “a” and “b” of paragraph 2 of the requirements for the format of electronic documents submitted for state examination of design documentation and (or) engineering survey results, approved by Order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr, establish formats of electronic documents with text and graphic content submitted for state examination.

The requirements for the format of electronic documents submitted for state examination of design documentation and (or) engineering survey results, approved by Order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr (hereinafter referred to as the Requirements), do not establish a closed list of versions of electronic document formats submitted to state examination. FAU "Glavgosexpertiza of Russia" accepts files in the formats specified in the requirements and developed in any AutoCAD software.

In accordance with the order of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated December 9, 2015 No. 887/pr “On approval of the requirements for the composition, content and procedure for drawing up the conclusion of the state examination of design documentation and (or) the results of engineering surveys”, a conclusion prepared in the form electronic document, signed and approved by enhanced qualified electronic signatures.

According to paragraph 18 of the Regulations on the organization and conduct of state examination of design documentation and engineering survey results, approved by Decree of the Government of the Russian Federation of March 5, 2007 No. 145, the submission of documents in electronic form is carried out using, inter alia, the federal state information system “Unified Portal of State and municipal services (functions)" (hereinafter referred to as EPGU). Please note that in order to register in the SIVZ Personal Account, the applicant must have a confirmed account on EPGU.

The electronic signature of all documents is carried out in a manner similar to the signing of paper documents.

The procedure for transferring the conclusion to the applicant includes sending the conclusion in electronic form (using the “System of interactive interaction of the State Autonomous Institution VO “Center for State Expertise in the Voronezh Region”) and, if another form of issuing the conclusion is indicated in the application and (or) agreement on conducting the state examination, on paper in the hands of the applicant or by sending a registered letter.

If it is necessary to obtain a contract for expert work on paper, this information should be indicated in the application.

According to paragraph 10 of the order of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated November 21, 2014 No. 728/pr, the name of the electronic document must correspond to the name of the document on paper. In this case, naming files with abbreviations and entering valid characters is possible.

To work in the Personal Account “System of interactive interaction of the State Autonomous Institution “Center for State Expertise in the Voronezh Region” with the applicant when submitting project documentation for state examination and/or verification of the reliability of the determination of the estimated cost”, you must use a confirmed account of a legal entity or individual on the Unified Portal of Public Services . Documents submitted in electronic form are signed by the head of the organization or his authorized person using an enhanced qualified electronic signature provided for by the Federal Law “On Electronic Signatures”. The differentiation of access rights is strictly tied to the user’s Personal Account. The user sees only his own requests.

The requirements for the format of electronic documents submitted for state examination of design documentation and (or) engineering survey results, approved by Order of the Ministry of Construction of Russia dated November 21, 2014 No. 728/pr, do not establish the form of the information and certification sheet.

However, according to the order of the Ministry of Regional Development of Russia dated April 2, 2009 No. 108, the execution and design of text and graphic materials included in the design documentation must be carried out in accordance with the national standards “System of design documentation for construction”, which are approved by orders in the prescribed manner.

Currently, the Russian Federation has a national standard GOST 21.1101-2013 “Project documentation system
for construction. Basic requirements for design and working documentation." According to Appendix D to the specified national accounting standard when performing graphic and text documentation
for construction is also subject to the interstate standard
GOST 2.051-2006 “Unified system of design documentation. Electronic documents. General provisions." Appendix B to GOST 2.051-2006 shows the form of the information and certification sheet.
